The article desperately needs an editor.

I'm surprised the charge of discharging a firearm inside a building wasn't dropped the moment he was acquitted of the other charges. The man has been held without bond the entire time and is still awaiting despite the other charges no longer being a factor.
 
Slightly surprised from what I read shooting the guy seemed a bit like an over-reaction.

It's about power and showing others what will happen.
 
1. Colie was kept in custody throughout trial and remains in custody? WTF.

2. The Cretin attempting to make YouTube content is generously labelled as a “Prankster” but seems more like a fatherless idiot. When one conducts themselves in such idiotic manners there are a list of consequences and getting shot is on that list.

I‘d say the idiot classifies as the nozzle, not the bag.

That the shooter is still locked up is BS. Eventually there is going to be serious blowback from politically weaponizing the legal system against normal people.

However, I will also say that this was probably a case where some form of intermediate, less than lethal, option would have been the best. A face full of Fox Labs would have given the heckler something to think about.

Idk about that being a great shoot. The OP’s linked article says shooter’s path to escape was blocked by a crowd of 20-something’s. I saw 2 dumb kids being incredibly rude, not backing him into a corner. No classic pre-attack indicators, no overt signs of aggression (aside from ignoring personal space). Seems like a great example of when to use OC.

That said, it’s BS that the guy has been held in jail this entire time despite being found not guilty. And the discharge inside a building guilty verdict conflicting with the self defense finding, shows the jury was highly conflicted, confused, or plain dumb. I’m guessing they agreed that they’d find him guilty on that felony if the holdouts would find not guilty of the assault. Either way, it shows how unpredictable/unreliable a jury can be.

Must have a public defender. I hope he files civil suit against the tuber for all the wages he lost plus damages got being locked up.

Hard to say bad shoot with limited video shown. Yes it’s cherry picked limited video. Everyone has a camera with them now. How long did the guy harass the shooter? What happened that we haven’t seen? This is the only video published.?. Nobody recorded anything? I call bs.
I’m not physically able to defend myself like in my younger days. I carry a gun to increase my odds of survival.
I find it hard to feel sorry for the person harassing the shooter. If more folks would buck the system and start fighting back things would change.

They surrounded him and prevented him from freely leaving on multiple occasions. THEN he shot him the last time they blocked his ability to leave. That's awfully close, if not officially, kidnapping. Which should be a felony. Which should initiate an abiility to use deadly force. Hindsight does not actually change what the shooter felt in the moment. It just gives us more info to realize how stupid these clowns are.

This is one that I think would be interesting to look at the AOJ principles through the shooter's perspective. Clearly the crowd provided disparity of force giving them the ability to cause harm sufficient to justify deadly force. The fact that they were repeatedly advancing on him and blocking his escape routes when it was obvious and apparent, he did not wish to engage, I believe demonstrates opportunity and intent. What isn't clear is the jeopardy part. Their behavior was undoubtedly menacing and apparently was enough to make the shooter believe he was in imminent mortal danger, but I'd be curious to hear his explanation of the threat.

On a side note, if I were on his jury, I seriously doubt I would convict based upon what I've read about this case so far and would give him the benefit of the doubt in terms of perceived threat.

That seems like an intentionally vague phrase, but when someone is forcibly having that presented to their face I can buy that the victim perceived that as a threat of sexual violence.

Add harassment charge to the mix. He did not look too good when they strapped him in for the ambulance ride. No doubt he will run into a guy or gal who is having a bad day and it will not end well for him. He was asked three times to stop and he kept pushing the envelope.

I've said several times that eventually one of those dumb little pranksters were gonna mess with the right one and get put down. People need to know in today's time it's not a good idea to mess with people past a line. He was told to stop more than once, man tried to walk away from him, he said he would call the law, then ultimately pulled it. Shame.

Because generally speaking committing a felony against someone constitutes a legitimate use of deadly force to defend yourself. DC statute on kidnapping, it's a Class A felony. Note the seizing and confining phrase as well as the lower conspiracy part. They need to hammer every one of these idiots for this.

Whoever shall be guilty of, or of aiding or abetting in, seizing, confining, inveigling, enticing, decoying, kidnapping, abducting, concealing, or carrying away any individual by any means whatsoever, and holding or detaining, or with the intent to hold or detain, such individual for ransom or reward or otherwise, except, in the case of a minor, by a parent thereof, shall, upon conviction thereof, be punished by imprisonment for not more than 30 years. For purposes of imprisonment following revocation of release authorized by § 24-403.01, the offense defined by this section is a Class A felony. This section shall be held to have been violated if either the seizing, confining, inveigling, enticing, decoying, kidnapping, abducting, concealing, carrying away, holding, or detaining occurs in the District of Columbia. If 2 or more individuals enter into any agreement or conspiracy to do any act or acts which would constitute a violation of the provisions of this section, and 1 or more of such individuals do any act to effect the object of such agreement or conspiracy, each such individual shall be deemed to have violated the provisions of this section. In addition to any other penalty provided under this section, a person may be fined an amount not more than the amount set forth in § 22-3571.01.

This is the good thing about being raised in some bad areas.
It would never occur to me that I could stalk some dude with my hand in his face and stare at him aggressively without talking....without getting happily straightened out, by someone that feels an obligation to improve society.

And I think it has way more to do with when you were raised than it does to where you were raised.

And it also seems like most people would have either just ignored the guy or kicked his ass… not pull a gun

I guess I’m in the minority, but the shooter seems like a scared little twerp. If that encounter made him fear for his life and he seem like a pretty big wimp.

I totally get the schadenfreude instant Karma aspect, and it makes me giggle, but I’m still wrapping my head around actual justification of lethal force
