Specific law(s) would help to answer the question.

§ 14-415.1. Possession of firearms, etc., by felon prohibited. ... The term "conviction" is defined as a final judgment in any case in which felony punishment, or imprisonment for a term exceeding one year, as the case may be, is authorized, without regard to the plea entered or to the sentence imposed.

Welcome, we're happy to have you with us. Since this is a Welcome tread, you might want to start a new thread for your question/poll.

Welcome
Chat with one of our wonderful mods about the leagal/legal bit, Im sure they'd be happy to get that changed for you

To somewhat answer your question, I'll just have to say that it would be nice if the firearms laws that are currently on the books with regards to dangerous felons were actually enforced at all. As a Libertarian, I feel that if you pay your debt to society, your rights, including 2A rights should be restored.

However, and this is not a "I support the 2A but" statement, I personally feel that when a violent convicted felon is convicted of a violent crime using a firearm, then the existing laws that are on the books should be enforced and that criminal taken out of society and sent away to prison for the maximum amount of time the law allows , but that is just not happening today in our judicial system. They, the lawmakers, keep wanting to make up new laws instead of enforcing the laws we already have on the books.

I'm pretty sure if one is caught as a convicted felon, in the act of committing a violent crime with a firearm, his punishment is pretty severe. Not unless he/she has very deep pockets, and a very good lawyer. If someone is deemed so violent and so untrustworthy, why release them back into society? My opinion is, the law for a convicted felon is not just. The title "felon" itself is harsh for non-violent crimes. Felon, carries a certain stigma, that makes one think(murderer, rapists, and so on) ugly thoughts about someone they don't even know.

You can't take a RIGHT away. It's a right, givin to us by our creator. As human beings, we have the right to defend ourselves against unjust force. Life, liberty, and freedom is protected by the Constitution. It is the supreme law of the land. Any laws written to the contrary are dangerous to its citizens.

Pay your debt to society you should get full restoration of rights. The right to bear arms and the right to vote. Felons beside your name already pretty much assures you are not getting a job at most places. That in its self starts another cycle of crime.

Let me add criminals do not get sentences long enough in most cases. And a speedy trial is a joke.

That's weird. I wonder how all of those violent convicted felons that were convicted of violent crimes, that are shooting and killing people up in Chicago and other large metro areas, I wonder how they are still running loose?

If someone steals a snickers bar at 20 and gets arrested for it but pays his debt and never does another crime I would not have an issue with them having 2nd rights restored. But let’s face it, most felons have long rap sheets and everything is plead down so if they do end up with a felony that person prob has committed multiple offenses. Sorry but they have shown that they cannot be trusted and therefore it’s a no IMHO.

To me, it’s simple. If you commit a crime and are deemed untrustworthy with a firearm then you either shouldn’t be released from prison or you should be executed.

I still think we should just take one of those square shaped midwestern states, wall it all in, and make the entire state a free range prison. Toss violent offenders over the wall with a butter knife, a box of Kleenex, and a blanket. If they survive 5 years, they go free no questions asked.

My dad was in prison for my whole life until he died on 3/4/16. He was convicted of 2 counts of 1st degree murder serving 2 concurrent life sentences. Yeah, he screwed up big time, we never met until I was 15, I still miss him today. We didn't see much of one another. I wouldn't trust him to stay at my house if he was out. I have stuff placed all over my house.

I'm pretty sure you are wrong there. Our criminal Justice System nowadays is such a revolving door that the vast majority of Violent felons keep getting slapped on the wrist, let out to prey on society over and over, until they finally do something so heinous that they finally get sent away to do real time.
Most of the time, when a felon is caught again, especially using a firearm in the commission of another felony, the gun charge is one of the first bargaining chips to get plea bargained away. I did a report in school 10yrs ago, we had an 18 month stretch where every murder in our 3 county area, 30 plus murders, were committed by a felon who should have been in jail or prison the time they committed the murder, but were turned loose by judges, either let out on bond, even though they were prior felons, even while they were out on bond for another felony, or were supposed to be in prison but had their sentenced shortened , suspended or overturned by a judge.
We need to reform our criminal system, lock our felons up for long periods of time and make jails and prisons so horrible again that people don't want to go back again.

You sound like a felon talking.

Are you a felon yourself?
Yup, sure am. Sad but true. I did a terrible disservice to my family, my community, and myself. I didn't kill a man, nor would I ever, but seeing the comments in here. No one has faith in our justice system, no one has faith that a man can change. I never set out in life to become a felon, but I did. Even after spending time in a prison, getting released, and just talking to people around me... In this forum tonight, I see that people believe a man should be punished for the rest of his life for a sin. I'm glad that man is not God. Just remember, people make mistakes, and no one in this forum or country is perfect. I'll ask for forgiveness, and I'll pray for those who can't, and when tyrants come to take your rights away. I'll stand and fight and die beside those who'll stand up for what made this country so great. Today I just go to work, come home, to my future wife. Help take care of her and her kid, put food on the table. I just want a calm and happy life. Yet, I see people looking to wipe their ass with the very document that made this country so great. Clapping for the murder of babies. What happened to America? So yes, I want to protect myself, I want to protect my loved ones, and I'm willing to fight for America!

Have you ever been to prison? I have, and most of the felons in prison where in there due to drug charges, drugs that are legal in some states. The violent offenders, they had life sentences. I met some murderers who had 10 years, some 20, but most, life. Prison worked for me, I had just enough time to get clean, read the Good book front to back a many a times, get set up with a job while I was in and held it till I got out. It's all up to the individual and their choices after release. Not everyone is the same, but everyone is lumped into the same category. All it's going to take is a stroke of a pen and law abiding citizens will be turned into felons overnight with these ERPOS and Red Flag Laws.

Does anyone here believe the laws being enforced against felons is a violation of ones Constitutional Rights?
No one is denying you your right to life. We all make choices that we pay for. You have the right to life, liberty and the pursuit of happiness. The same as everyone. Even though you are a felon. The only difference is you can't LEGALLY own a firearm. Your pursuit of one adds some suspicion that you are reformed only to the extent of an interpretation of law. The law is that felons cannot purchase or own a firearm. Your questioning that law, like I mentioned, leads one to think that you don't respect the law and you have chosen the laws that you DO respect. Another thing. If you are a born again Christian it should be easy for you to complete a life cycle without ever needing a firearm. My question to you now is ... Why do you even want one so bad as to question a law governing it? Especially since you met many felons who probably shouldn't own as much as a letter opener.

What frustrates the hell out of me is that being a felon, for any reason, bars one from possessing a firearm even if a firearm was not used in the crime.

Do we strip one of their 4A rights for being a felon? No
Their 1A rights? No.
Their 5A rights? No.
Their 9A rights? No.
Etc, etc, etc. - so what makes the 2A so different?

Either one should pay their debt and be released and have all rights restored OR if they are still deemed a threat, still be locked up.

By saying they can't have a firearm, the law is simply stating they're still a threat. So why were they released?

What makes 2a rights different is a 2A right refers to something tangible. Ethereal rights can be lived inside a mind. Much like what we are all doing today to some extent.
2A rights should be taught and also the denial of those rights should you become a felon. A felony is an irresponsible act. The laws existed before the felony was committed. Explain to me the impetus for the thread contributor failing to take action for ratification of this law BEFORE the felony was committed? What I am saying is, if you perpetrate a felony you will suffer the consequences of it. If the law was unfair then. Why didn't you complain before you became a felon? The reason is before you became a felon you had no complaint. You are a bit late don't you think?

A well regulated militia, being necessary to a free state, the right of the people to keep and bear arms shall not be infringed. Yet our rights are being infringed upon. It's not about just the 2A. It's about one's pursuit of life, liberty, the pursuit of happiness. Any attack on the Constitution is an attack on Freedom itself. You're questioning me like I've got some type of nefarious agenda. I live well within the Law, I don't have to like them, but I do respect them, but for you to question my moral character, and attack me on my beliefs is atrocious and an insult. I'll ask you this, why do you need a gun? Is it just for hunting, sport, or self defense? Just look back at history, and you'd understand, that Christians, of all people have been persecuted for thousands of years. It's hardly reported on, yet it happens. There's evil people in every aspect of human life, in some of the highest places of government, you know it, I know it, and more and more people are waking up to it's ugliness everyday. So yea, I feel very wronged by an unjust, unconstitutional law.

I ask not to be snarky, but what is your goal here?
If you hang out here long enough you will find that there are some who worship the notion of law as if it’s some divine power and it’s agents are angels sent from the heavens. You will also find that there are some here who think the system is an illegitimate joke and a farce that has lost any semblance of right and wrong and if you take away the trappings of officialdom you have something that resembles the common street thug. Most folks are somewhere in the middle.

I myself, believe that one should either be a full citizen with all rights or you’re too dangerous to be allowed out in society. I think the courts, jails and prison industrial complex is a failure. Crimes are either of the sort where there should be recompense and corrective action or if they’re severe enough the punishment is swift execution.

I think law has become divorced from right and wrong and has become a tool of the oligarchs that deign to rule and that there are too many victimless crimes and crimes against the state that should not exist.

You happened to do something that got you labeled as a felon. It sucks. And I don’t believe it should be a scarlet letter that brands you for eternity. And as I said before, one should be a full citizen or their too dangerous to be allowed out.

Look, I wasn't sure what answer to expect so kudos and thanks for the response.
I'm not gonna lie. I'm ashamed of my crime, it just looks like to me, since upon my release, no one seems to have any faith in our justice system. Which is sad IMO. It seems like people have lost compation towards their fellow man. I remember being incarcerated with an ex Catawba county Sheriff, who murdered his grandmother, I remember seeing the pain in his eyes when he told me his story. It brings tears to my eyes just typing about it. This man was a good sheriff, who got drunk and made a very bad mistake. People make mistakes, and no one is perfect... None. Do I think this man will go out and murder again? No. Do I think he should be punished the rest of his life? He already is. As am I, and I'm not talking about by the law, our own conscious, and own convictions are punishing us. To those who have committed a long list of violent crimes, get a second chance and continue to do so. Are not convicted, are not convinced they've done anything wrong. They aren't real hard to spot either, even while they're in the system. They're behavior, and actions tell on them. In my experience some don't learn from their mistakes, some do.

With all due respect, my first reading of this post inclines me to disagree with most of it.

Just a slight note about "If you are a born again Christian it should be easy for you to complete a life cycle without ever needing a firearm.":

Being a Christian doesn't make us bullet proof, nor does it magically shield us from harm (on the contrary many times). And while I do not believe violence should be the first option, ever, it >is< an option.

Look. You come in here on your first post " fired up" about your current situation , ask people their opinion, based on hardly any background. And we don't even know you. So dont get all riled up when people give you their opinion. Muzzer doesn't know you, he's a 70 year old man with a heart of gold. He's not trying to be an ass to you personally.....so take a breath....and stop taking this so personally.

How about taking a little bit of time to look around, chill out....get a feel for the forum....instead of being the high strung bull in a proverbial China shop.

I looked at your profile....14ish posts on the same thing. 1 to buy a firearm. Someone mentioned the Scarlet Letter up there....you are currently letting yourself be defined by this occurence. I'd change that if I were you. That was worth what you paid for it.

Jail and prison are two different things. My experience has been that once a felon... Yeah, yeah, I know. There's guys out there who left the grey bar hotel and became saints but those are few and far between. Prison gives what almost amounts to a college degree in criminality.

What is going on in here?
Hello Is This Legal, and welcome to the forum.
Thanks, I'm not getting

It's an antique firearm that I was looking to buy. I feel attacked already. I'm just a little riled up because, it's so easy to write someone off due to their past. I just wanted to see where people stood. When I read you guys group statement, I felt people in here would be for protecting ones rights. I see a very strong push in our country today to silence free speech, and to disarm the American people. Law enforcement officers are speaking out about it, ex law enforcement officers are speaking out about it. Sheriffs in Washington state, New Mexico are speaking out, and receiving death threats. We are living in dangerous times sir, so all I want is to make people aware. The law we all thought we lived under is not the same.
