I have to agree. I don't particularly like it, but I also think it falls under freedom of expression/speech. And is he really threatening by himself, in a T- shirt and shorts? Besides, he can't see crap out of it anyway.

Are you implying he's less of a threat because he's in shorts and a tee?

Is freedom of expression a hate crime?”
No
“Hate crime” is a ridiculous charge developed by a whiny pansy. If I punch, stab, shoot, spit upon someone, it’s motivated by hate.
Charge for the actual crime.

Maybe the hat’s his norm, he just grew up having to wear the dunce cap in class.

I'll WAG that "thug culture" has killed, maimed, and terrorized 1000 times more people than those associated with that headgear ever did, so let's have pants-around-the-thighs and hoodies get charged as hate crimes too: Those garments are intended to send a notification of potential for mayhem, so they terrorize and offend me.

If the guy thinks it’s a joke or “F U” to the authorities, I wouldn’t be upset if he got blindsided by Mike Tyson for being an idiot.

Regardless of the fact that I disagree with it, the Sheriff has zero business being involved unless he’s made threats to people IMO. Some Cali pansy being scared at the sight of this guy, doesn’t qualify as a hate crime or any other crime. The store has the right to ask him to leave and to trespass him for life.

This is one of the down sides of the freedom we enjoy. No, you can’t “fix” that.

It is worth mentioning that anything involving "hate speech" has been pretty much impossible to prosecute because the supreme court has repeatedly ruled that "hate speech", unless actually calling for violence by a person who has followers who can do so or done specifically with the intent to create fear, is still protected by the 1A. Hate speech cases fall apart pretty fast.

Who would have committed the more serious crime in your scenario?
Not the point, but you obviously know that. We can argue all day long about right and wrong, legal and illegal, but I’m not that bored.

I agree it's not a crime but it's in such poor taste that I'm perfectly willing to turn my back on that particular moron and let the sheriff harass him all he wants.

Heck yeah man - we should have LEO going around all the time harassing people exercising their 1A rights in a way you don't agree with, right? SMDH

You must be one of those, "I support the 1st amendment, but,...." types.

To answer the OP,.... I don't believe in hate crime or hate speech. I see things everyday that I personally don't support or agree with, but it never crosses my mind whether it's right or wrong, or whether I think they should or shouldn't do it.

Yeah...not sure I would chase that rabbit down...

Maybe I shouldn't, but pisses me off someone being ok with LEO harassing someone who isn't doing anything wrong. I think the dude wearing the klan hat is asking to get his butt kicked for wearing it in public, but it's his choice.

They gonna arrest the Virginia Governor too?

Personally I think it's stupid and in poor taste, if he thinks it's a joke. If it isn't a joke, then I hope Mike Tyson punches him in the piehole or some other random black dude does. I'll giggle about it too. Actions: they have consequences.

Whether a joke or not, I wouldn't be associated with it. But yes, it should be completely legal of course.

No doubt, but sometimes people just respond tongue in cheek, I highly doubt you and his view on the 1st are all that different. Besides...may save an unsuspecting business owner from being hassled by the LEO for opening or arresting a mom taking her kids to the park.

Well in that case if was made of gold lame and had a racial slur beginning with “N” emblazoned upon on it, then it’d be a real statement.
Probably a past statement in the party period of New Orleans.

Illegal? Nah.
Jerk? Yeah.
This guy knew what he was doing, he wanted to rile people up. It wasnt just a 'bed sheet' or something so simple. We all know what it represents

After thinking about it a bit. that's simply a social distancing hat. NO ONE wants to be within 10' of him.

Shoulda went with this hat instead:

That was in CA? Yeah they are gonna string that guy up without even a hint of irony. Again, I don't support him and I don't find any humor at all in using despicable symbols for shock value. If you're not Mel Brooks, you probably aren't clever enough to pull it off.

I have to say I'm fairly astonished at the extent to which people here will (1)decide who gets to use a symbol as free expression and who does not, and (2)feel an apparently strongly programmed obligation to distance themselves from a Democrat organization that barely exists anymore.

There is nothing illegal about inciting fear
