Yeah, go ahead and buy legal pot, recreational or medical, doesn't matter. I saw this coming when they started legalizing pot in different states. They are eliminating gun owners with each sale.

From the Form 4473:
e. Are you an unlawful user of, or addicted to, marijuana or any depressant, stimulant, narcotic drug, or any other controlled substance? Warning: The use or possession of marijuana remains unlawful under Federal law regardless of whether it has been legalized or decriminalized for medicinal or recreational purposes in the state where you reside.

So, if you use pot in any amount, you should check the "Yes" box to this question. Our FFL members can tell us what happens to a transaction if someone should check Yes on the question. Does the transaction stop right there?

Depressants: Alcohol
Stimulants: Nicotine
Controlled Substance: Sudaphed (or anything else behind the pharmacy counter)

All it takes is a matter of opinion if you are "addicted" or "unlawful user"...

I agree with @Burt Gummer ... don't ask, don't tell.

When I look at the question I see it written as "Are you a moron?" Check yes or no.
 
Only buy via private sales? State legal MJ creates a whole lot of problems users don't think of. If the state has MJ legal and a law that every gun sale has a paper trail with that type of question = legal conflict.

Basically I don't think users care about that question, or more. Not just guns there are a lot of other issues... Employer drug test for one.

Thought about this. In a state where you are standing (legal use laws) the answer would be "no".

How you answer the question isn't really the issue. The issue is that you can be classified as an illegal marijuana user by obtaining the card. PA recently unlinked their medical marijuana registries from the state law enforcement database to get around this, but it will eventually be forced to link it back up.
 
Of course some will claim that Uncle Sugar has made MJ "illegal" at the federal level ... Blah blah blah. Uncle has NO business trying to make MJ illegal in the first place.
 
This thread got me to thinking (yeah, unusual...).

If a 'state' says recreational MJ is legal, can that 'state' also mandate no MJ use for state employment? I say, no, as it sets up a legal conflict.

Keep in mind I'm not a layer but I probably will sleep in a Holiday Inn at some time.
 
There was a thread on DC where a guy went into a dispensary with a buddy of his. Not buying just with him. They checked their ID at the door and I guess he didn't notice they scanned them. A couple weeks later CO notified him that his CCP was no longer valid and had been canceled. Just for walking in the door!

And all this legalization still does not address drug tests related to jobs either.

I don't know about CO, but NC links your DL And CCP pretty closely. At most it's one click away on the DL check. Or at one time NC used the same # for both. IIRC the dispensary has to report the licenses they scan to the state, and they scan them to let you in. Then that info is passed on to the state apparently.

I would probably answer that the same way I answer the questionnaires at doctor's offices asking if I own guns.

I'm in Burlington and I think it depends on the doctor. I've only had it happen once. It's part of the medical history stuff you fill out when you first get there when it also asks if you drink or smoke.

It's part of the big push to re-frame guns as a "public health" issue. Big hospitals andhealth networks are on board. Small doctors in private practice, not so much. But the independents are getting harder and harder to find lately since all the extra paperwork demands of Obamacare are making it expensive to operate a business.

CBD is derived from hemp. There’s no THC in the legit stuff. So no. I still stay away from it because I can’t afford to piss hot or want the hassle. Don’t want somebody’s screw up to be my hassle.

And pediatricians (and staff) also ask children if Daddy or Mommy have a gun. My kid was an asshole (I try to teach him correctly) his last physical for the high school baseball team when the physician conducting the physicals started his inquisition ... one of my kid’s replies was “I know Mom’s got a glue gun and Dad has a staple and nail gun”. They also asked about parental smoking and alcohol which pissed me off big time. Today’s medical professionals seem to be getting worse and worse on the liberal scale and their God Complex increasing also.

The folks that will worry about checking the box are the same ones that won't tear the government labels from their mattresses. Unless you have plans to run for POTUS nobody cares enough to research your life choices for a gun purchase.
