INCIDENT TYPE – SERIOUS ASSAULT / HOMICIDE AT 400 HICKORY LN
HIGH POINT, NC

On July 26, 2019, at approximately 10:04 pm High Point Police officers responded to a residence located at 400 Hickory Ln after receiving information that an assault was in progress where a female was being assaulted by a male who was possibly intoxicated. Officers arrived on scene and made contact with the victim who stated that a B/M suspect known to her had assaulted her by grabbing her and choking her, and pushing and shoving her several times. As a result of this information, officers prepared to enter the residence and arrest the suspect but soon learned that he may have access to a firearm inside the residence so a perimeter was established around the home and the Tactical Team responded. Several attempts were made to contact the suspect inside the home with no success so officers applied for and were granted a search warrant and entered the residence just before 2:30 am only to learn the suspect had fled the residence during their initial contact with the victim and was no longer inside.

On July 27, 2019, at approximately 4:10 am High Point Police Officers were again dispatched to 400 Hickory Ln after receiving information that a shooting had just occurred. The caller identified herself as the victim from the earlier incident and reported to dispatchers that she had shot a man (the suspect from the earlier call at the residence) who was inside her home after he charged at her with an ax. Officers arrived and located the caller her daughter as well as a firearm in front of the residence. Officer located the man in the rear yard of the residence deceased from an apparent gunshot wound.

The man's identity will be not be released at this time due to failed attempts to identify, locate and notify next of kin.

High Point Police detectives are still conducting an active investigation into this incident. During this investigative process detectives will continue to conduct interviews of potential witnesses and involved parties, conduct searches of any people, vehicles or places that may contain evidence of the crime and collect any other relevant materials that may aid in investigation or prosecution. For those reasons, no additional information will be released at this time related to this incident which includes any victim/suspect information and details specific to the active investigation.

Updated information will be provided as soon as reasonable at the appropriate time.
 
If this occurred at the assault victim's residence, why did the police get a search warrant before going in to look for the assailant during the first visit? Wasn't the victim's consent all they needed to enter her residence at that point?
Maybe she wasn't on the lease?

Homicide: The act of one human killing another. So yes, this meets the definition. Doesn't mean it wasn't justifiable.

Looks to me like that property may be a "rental". The owner is listed at a different HP address. Not sure whether that makes a difference in needing a warrant.

I think you are right, but I bet this was CYA. Hot situation, just hold the perimeter and cover your bases. Gives him time to cool off and if they end up having to use lethal force everything was done by the book. My uneducated guess but I did watch Live PD last night. :rolleyes:

I would say it was a CYA situation. I would guess they would have taken the person offsite to interview so she couldn't withdraw consent without being present.
 
If he indeed had an axe it's a Castle Doctrine... I'm good with it.

I’m good with it as well. But I don’t think a weapon is required anyway because a man vs. a woman is usually considered a disparity of force.
 
Yes, legally it is called homicide. Morally it would be justice. If the whole thing was a setup so she could get rid of this particular individual I call that clever.

Yes, it is a homicide but they'll have some trouble proving criminal intent from what I just read.

Homicide does not equal Murder. No need to get riled up.

As far as the search warrant, I'm not sure why they needed it with the resident there to give permission but I think High Point has their own attorney and probably thought it would be prudent considering there may have been gunplay involved.

It didn't cost them anything.
 
Hickory Ln is on the border of the hood. Lots of small unit, low cost housing, on postage stamp lots. Typical rental region for those that want out of the hood, but can’t afford to be in the good parts of town. It’s also not too far from where HPU has been buying (? Or being given, again ?) up property left and right and pushing the seedier aspects out further.

Off hand, I’d put my money on it being a true domestic and lawful self defense, but without more details the reporting could paint a staged set up picture. In the rear yard could be considered curtilage subject to castle doctrine.

I have an ex SIL that along with her live in concubine, lured her estranged husband to the house and killed him. Yes. I know this for a fact. Some time later I was talking to the CSI in charge, hell this was in the early 80s they weren't even called CSI then. He knew what happened and said..if she hadn't killed him somebody else would have.
