Bill of Sale... Really?

TBF ... I do a BOS for anything expensive, gun or otherwise, just because I'm OCD and like to keep records.

I don't ask for anything we don't both already know. I also don't surprise people with them at the last minute like an afterthought.

A BOS is not required, so why do you bother? Insurance doesn't ask for it? "Just for my records" doesn't sit well with me anymore. People have gotten stupid with trying to cya and it troubles me. Why not be a MAN and not take it? Ask questions, demand results? WTF?

None, I just believe we have enough laws that we don’t need. No need to make up more to make us feel good about something. People who want these thing still believe the guns are the problem.

This place rivals even my experiences with members of the armed forces for making stuff "gay".

And on the actual subject, I prefer not to add more layers of documentation and regulation and BS to a transaction, so you had better be offering something I can't get elsewhere or at a bloody good price to get a BoS out of me. If you're a "Papieren bitte" sort of fellow, I'll probably pass.

You know, when I was actually buying guns lol

Everyone draws the line somewhere. Where is up to you. When you make a deal for a sale or trade do you have them come to your house or meet in a public place or perhaps in the shady side of town. I am guessing a public place but that is just me. I dont really want any and everone knowing where I live. I doubt many here would. Do you feel comfortable dealing with someone who just joined up or would you rather deal with someone who has been around a while? Point is some feel uncomfortable with certain things. What you feel comfortable with is up to you.
 
So you would pass up a good deal on a firearm because a BOS is not rquired by law? Ok.

Read my earlier post. I did 2 weeks ago. Also would have passed on a Galil for 1k Monday if the seller wanted anything more than the law allowed. I don’t care if the seller wants that stuff, it’s his firearm. Doesn’t mean I have to accept it.

By the time I agree to by or sale a person a firearm, I will have made up my mind whether I'd complete that deal on just a handshake, nothing more or less. There is no law that I consider valid that pertains to celling my personal property. It's about trust, and I haven't met anyone here I don't trust.

Working on that one everyday. Once I know them all does that mean I have to trust them all? Do you trust all of them?
After you spend a couple of years following posts here you start to learn the “personality” of the community whether you’ve met folks in person or not. BOS is one of those topics that you learn is a real hot button topic, and there are strong feelings and opinions for and against.

These debates crop up on this subject every few years and usually generate lots of pages of animated discussion.

I get that. Me personally, I don't care one way or the other. If you want a bill of sale I will do one. If not I don't need one. The thing I find strange is those against a BOS say you gotta trust who you are dealing with yet they don't trust enuff for a BOS. Just seems strange to me.

Either the buyer meets the criteria, or he/ she doesn't. Simple as that. Any extra paperwork makes the seller an ffl. For my records, means you are an ffl, keeping records.
 
You guys in NC have different regs than we do in SC, we don't have the handgun permit thing to deal with. So basically you NC guys an additional form of I.D. to present to a seller than we do.

That said I have plenty to loose if I should somehow sell to a prohibited person so I use a B.O.S. with the following disclaimer in the rare instance I sell something papered to me;

By my signature above, I certify that under penalty of perjury that I am not under any legal disability from purchasing or possessing a firearm under federal, state, or local law. I agree to hold seller his heirs and assigns harmless from any actions resulting from my use, possession, improper or unsafe storage or sale of this firearm. Further should I come under disability from possession of a firearm I agree to surrender this firearm to the proper authorities or return it to the seller and assign title to him. I am not acting as an agent for any person, business or agency other than myself for the purpose of this purchase and it is solely for my own use and possession and not for resale, trade, or gift. Seller warrants that this firearm is from his private collection and was not purchased originally for the purpose of resale and he is not a dealer in firearms or weapons and warrants that to the best of his knowledge and belief he purchased the firearm legally. At a later date should the firearm be declared unlawful, illegal to possess or in violation of any local, state or federal law, purchaser his or her heirs and assigns agree to hold seller harmless and without fault or recourse. Wow, that's a lot of sh!t. I have signed many bills of sale and have given my information to many people.

Now. What is actually required? That's the question. Am I a lawyer or wanting to be representing myself as someone worried about possible problems in the future? No. I am satisfying the NC laws.

Do we carry a list of references to DMV so that we can drive? No, we do the least we can do, and we show that we have insurance on the motor vehicle. We take the mandatory tests and then we pay our money. So the government can grow. lol.

I'll just keep this for my records isn't any good anymore. I'll just go to an ffl and buy a new gun. Unless it's something special of course.

Actually the legal onus is in the buyer, as he / she will be the one found in possession illegally. All that legalese in your contract can be summed up by asking "are your prohibited from buying this firearm by state or federal law?"

The NC CHP is just an easy way to answer "no" in a handgun transaction.

Oh and BTW dont open carry that firearm to and from the transaction in SC [emoji2]
 
I will not give anyone any more information then they can find by googling my name and phone number. If I'm meeting you for a deal you probably have both so it's not hard to find someone with that. You will not get my driver's license number, my CCP number or any other such ID. A BOS is stupid, it proves nothing. I'm waiting for people to start requiring the BOS to be notarized.

What's missing in this version of this perennial discussion is that The Buyer Has Requirements, not just the seller. If the Seller doesn't meet the Buyer's requirements, he don't git the money! :cool:

Reposted this because you seemed to miss the "Everyone" part. That would include buyer and seller alike so the buyers requirements were not left out.

This is the guy who wanted me to send him a picture of my CHP,, I even offered to go through a FFL and pay half. Someone offer him a a really good trade and see if he changes his mind when it’s in his favor, lol. I honestly can say if he said he would sell it to me for a 100 bucks I still wouldn’t give give pics it do a BOS

The irony in this is all the Fudds that demand this paperwork to "protect" themselves from The Man might be the first victims to lose their expensive trap guns and benchrest toys for their own self-righteousness.

I used to do BOS, I don't anymore. My thinking has evolved. I don't do anything more than what the law requires.

If someone has done something to alter the gun--put in a new trigger, etc--I will ask that they write it down and sign it just in case it blows up or it needs any work. Even then, depending on who it was and what they did, even that is negotiable.
 
Yup...remember in Red Dawn, the first thing the commies asked for was the paperwork for gun sales. All this "proof" people are demanding can possibly assist you, but it can also possibly harm you in a serious way.
 
I just remember Canadian Ed used to espouse the bill of sale on his forum. That's enough for me never to think about doing one or being party to one ever again.
