Bait shop owner convicted of fatally shooting man.


“We tracked it up this way and we stopped here to find that there was somebody back there in these buildings..and I had my gun...and I was aiming at him and the gun went off and shot the man right in the head,” Gore said in the 911 call.

"Is he the one that stole the boat?" asked the dispatcher.

“No, ma’am...the only thing I know is I screwed up. I’m going to be honest about the whole thing,” Gore said.



Sheriff's officials later confirmed that Blanchard and Thau had no connection to the stolen boat, but Thau was charged with felony larceny after the property owners said no one had permission to be at the mill.


Death incidental to commission of a felony?
 
So the “victim” was engaged in felony larceny (stealing scrap metal) at the time he was shot. The judge probably wanted to give gore a medal but 60 days was the best he could do.
 
So a thief gets shot while thieving. If I ever have to be on a jury, I want it to be for something like that so I can refuse to convict.

Gore was initially charged with second-degree murder but that charge was later upgraded to first-degree murder. He also faced a charge of first-degree kidnapping and second-degree kidnapping.
I’d probably refuse to convict just to give the stupid DA a big middle finger just for trying that.

And for the record, right and wrong and even law needs to be a function of The People not the stinking gub’mint.

I hate a thief as much as anyone but I don't think they should be killed. Tortured and cutting off body parts, I'm good with that.

Sometimes it happens. It was a result of trying to take from another. Play stupid games, win stupid prizes. I won't fault the victim.
 
Reading comprehension > me, but did anyone find the boat, or anyone involved in the boat theft.

Basically, the scrap metal thieves were in the wrong place at the wrong time? Amirite?

Firemen, tree trimmers and convenience store clerks are willing to accept the fact that they might die at work, don't see how thieves should feel any differently.
