Birdshot may not kill you...

Actually most cases I have read where "Castle Doctrine" or "Stand Your Ground" is questioned by the police and/or dismissed by the assistant DA as not applicable are those in which the perpetrator was retreating. If one shoots a person retreating, and that person turns out to be unarmed, one best have a good lawyer and deep pockets!:eek:

I think it's BS. I hate that if someone breaks in your house, which in my views, is a serious threat to you and your family, armed or not. If he breaks in without a weapon, that doesnt make him not dangerous, or take away that he could grab and kind of KNIFE, or blunt/sharp house hold object and use it as a weapon....

If someone breaks in another persons house, and gets caught and then shot/killed..... Tough luck! Shouldnt have been where you dont belong, ontop of breaking the law!!

I hate to say it like this, but if someones in my house, they arent leaving (unless they kill me first) I'd hate to think of that guy with the birdshot in his back and how painful that is and how PISSED he is, and being he probably wont get any serious time, if any at all... Now you've got a pissed off, peppered up bad guy that knows where you live.... and you shot him........... The 2nd time he comes back, you may not be as lucky.

On the flip side of the coin, he may not be so lucky, either.

Remember...the point of self-defense is to STOP the attacker, not to kill the attacker. That death may result as a consequence of using deadly force in stopping an attack doesn't mean that this is the goal.
 
Surprised me to find out my local PD runs bird shot if they are entering a home. I was skeptical until I talked to one of the cops about it. He said buckshot in the car, swap out for bird when they enter a house if they can.

This makes ZERO sense to me, in my 15+ years in Law Enforcement I've never heard of this being done, if I do a residence or building search and I use my 870 it's loaded with buckshot and slugs.

You should hate to say that - don't ever say it in a public forum. Lawyers will find it later should the occasion arise, to prove premeditated intent rather than necessary self defense. You should edit your post.

In Africa, professional hunters who have to track down and finish off a leopard a client has wounded often use birdshot for that very reason. Most shots in that circumstance are point blank because a wounded leopard will lie up and only charge if you get right up on them, which if you're following a blood trail is kinda the point.

Still doesn't make sense to me, why would I clear a house if the homeowner was occupying it? If I'm going into a residence or building after a bad guy over penetration isn't a concern. If the homeowner/lawful occupant was in the residence when we arrived chances are the sirens would have scared the bad guy away. 911 Operator could tell the occupant to come outside with no weapons to meet us. I think it's a policy put in place by an agency head. A small PD I worked for years ago put in place a policy of slugs only and no buckshot. My former Chief was concerned with "flyers" when using buckshot.
 
I can grab a Mossberg 590A1 without getting outta bed & that nasty girl stays stoked with 9 rds of 00. Federal's "LE" load, with the slower opening wad. It's a vicious round & anybody breaking into my house would be well advised to run for their lives.
 
Birdshot at close range hits like a fragmenting slug, but loses potential collateral damage and penetration quickly as distance increases. Buckshot is like a bunch of pistol rounds. Remember Rule 4, especially the "behind it" part.
 
Maybe he was diving for cover after seeing the shotgun.
Ayoob has said this many times. A shot in the back is often because the bad guy turns away at the very moment the defender shoots.
All this happens in nano-seconds.
