Do I keep the purchase permit?

Look up the penalty for selling one without the race permit. It's worth it to me as a buyer lol.

Class 2 Misdemeanor

§ 14-402. Sale of certain weapons without permit forbidden.

(a) It is unlawful for any person, firm, or corporation in this State to sell, give away, or transfer, or to purchase or receive, at any place within this State from any other place within or without the State any pistol unless: (i) a license or permit is first obtained under this Article by the purchaser or receiver from the sheriff of the county in which the purchaser or receiver resides; or (ii) a valid North Carolina concealed handgun permit is held under Article 54B of this Chapter by the purchaser or receiver who must be a resident of the State at the time of the purchase.

It is unlawful for any person or persons to receive from any postmaster, postal clerk, employee in the parcel post department, rural mail carrier, express agent or employee, railroad agent or employee within the State of North Carolina any pistol without having in his or their possession and without exhibiting at the time of the delivery of the same and to the person delivering the same the permit from the sheriff as provided in G.S. 14-403. Any person violating the provisions of this section is guilty of a Class 2 misdemeanor.

(b) This section does not apply to an antique firearm or an historic edged weapon.

(c) The following definitions apply in this Article:

(1) Antique firearm. - Defined in G.S. 14-409.11.

(2), (3) Repealed by Session Laws 2011-56, s. 1, effective April 28, 2011.

(4) Historic edged weapon. - Defined in G.S. 14-409.12.

(5) through (7) Repealed by Session Laws 2011-56, s. 1, effective April 28, 2011. (1919, c. 197, s. 1; C.S., s. 5106; 1923, c. 106; 1947, c. 781; 1959, c. 1073, s. 2; 1971, c. 133, s. 2; 1979, c. 895, ss. 1, 2; 1993, c. 287, s. 1; c. 539, s. 284; 1994, Ex. Sess., c. 24, s. 14(c); 2004-183, s. 1; 2004-203, s. 1; 2009-6, s. 2; 2011-56, s. 1.)

The second amendment doesn't apply to me selling a handgun...the terms of my sale are up to me.

Correct.

Engaging in private commerce with another citizen is covered under the right enumerated in Amendment 10 to the BOR...

The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people.

As a free citizen, the terms of your sale are up to YOU and rightfully so. Conversely, as a free citizen, the terms governing my potential sale(s) are completely up to ME.

What else is there to assume when somebody wants to keep their single use permit?? The law requires it to be used once. Assuring that happens doesn't go beyond the law.

Yeah? Well, throughout history, “the law” has required much that was unjust and immoral...just look at Germany in the 30s and 40s....but it was “the law”.

What happens when “the law” states that you cannot own a specific weapon, or perhaps, any weapon at all? Remember, it’s “the law”...whatcha gonna do? Gonna abide it? Gonna enforce it, if you’re in a position to do so?

When keeping a piece of paper that conveniently documents a voluntary transaction matches the severity of herding people into boxcars and gassing them then I might waste a few hours on hypothetical discussion about it.

When you find evidence of me harassing you about how you sell stuff please bring it to my attention!!

Fine...you do you.

Personally, I find any abrogation of liberty, no matter how ‘small’ or trivial it may seem to some folks, as a direct attack on the foundation upon which this Republic was built.

You must have a rough time getting through the day if you get this fired up about people you don't even know letting me keep their permits...world is full of much less trivial abrogations of liberty.

Okay, I’m bored now. Somebody start a bill of sale thread. You know, the one where the other party doesn’t tell you till you show up for the FTF.

:)

I am in agreement with you, this one is played out but there has to be a better topic than bills of sale. I refuse to start that one on principal alone.

I, for one, believe all firearm purchase restrictions are unconstitutional. But to protect myself I always ask for a permit, a copy of the license, a letter from their spouse to prove they can keep it, a college/high school transcript, three written character reference, a blood and DNA sample, and a notarized bill of sale. Those may not be the law (that I completely find unconstitutional), but are MY requirements.

And pictures.
Don’t forget the pictures.
