“I told him that, based on the way the law is now, if a background check was run on this CNA, there would be nothing to alert them that there were abuse confirmations. That’s as far as I got with him and he blurted out, ‘You want me to destroy this woman’s life!’” Herwinn recalled of her meeting with Bell.

Herwin said Bell watched the video, told her he didn’t see anything criminal in the video and ended the meeting.

“That’s all he said,” Herwin recalled. “No explanation. Nothing.”

If that were my mother they'd be asking if the DA was going to press charges against me for curb stomping those M'fers responsible. I don't think I would be able to contain my anger. If I viewed that video and it was my family member I would immediately find them and start hurting them without saying a damn word.

My only question about that is the legality. I thought in NC that at least one party being videotaped has to know and consent to it. If her mother has Alzheimer's she can't know and consent.

I'd still be curb stomping though and would do a hidden camera as well. The law be damned if you're messing with mine.

My question was geared more towards outing the assailants. Since the DA isn't interested in ruining their lives, maybe public shame will slow their roll.
 
So apparently in Gaston county it’s ok to smack people around. Sounds like two nurses could use a little working over.

Please don't call them nurses. They are patient care assistants. They haven't the education and calling to be a nurse. I am a RN so I know what I'm saying

My wife is an RN and now I know to call patient care assistants nurses, so as to get under her skin.

if her mom has alzheimers, then she probably has power of attorney and can consent to the recording for her.
and if she has power of attorney, there's probably nothing stopping her from taking EVERYBODY to court on her behalf.

My daughter is the Director of Clinical Services at several facilities here in Randolph County. I will ask about this as we have had some discussions about abuse but just generally.
 
Looks like it may be time for a tune up. I’m glad to see I’m not the only one with the same train of thought. I’m not afraid to sit behind the wall for a spell for administering some private justice. Don’t eff with kids or elderly people.
 
North Carolina has a Health Care Personnel Registry. Think of it like a sex offender registry. Essentially if you work in any sort of healthcare at any level and have substantiated charges of abuse you are theoretically barred from employment in the field.

Now for it to function properly, agencies have to check it when recruiting as they are required by their regulator or accrediting body, and agencies have to report to it properly when things like this happen.

On the mental health side of the house there is a state operated incident reporting system that automagically files a HCPR report when an incident report for abuse/neglect/exploitation involving a staff is created. Then there is an investigation by HCPR staff who substantiate, or not, the report based on evidence gained. All that takes place outside of DSS and outside of LE.

Now that all being said, Nursing homes may not have a similar system in place to make sure that happens. Either way, DSS should have investigated and the DA should have prosecuted.
 
My guess is the DA knows the video can not be used as evidence as that would infringe on the rights of those impounded in the rest home. If the video could be declared legal there would not be one rest home in operation today, they all are violations against humanity. Love that infringe word!
 
The video could be edited to mask any other patients in the room and afford them privacy.

Thats it. The DA nor the jury would be destroying anyones life. The idiots them selves will have destroyed their own lives
 
Absolutely disgusting what those caretakers did to that poor defenseless women. I work in senior care and would probably lose my job at what I would do to that person if I saw one of my residents being man handled like that.

That nursing home traded hands recently, and this isn't surprising. My grandfather in law was there in his last days.

As far as Locke Bell (and his office) goes, I can say the man impressed me thoroughly. Not sure of the particulars of this case, but I know for a fact that he went after a particular criminal like a bulldog, while many other liberal DAs would have let the while thing slide.
 
I'm surprised the family has not filed a civil suit against the nursing home. Not only would I do that, I would make sure somehow that charges were filed.
 
Policy and or law needs to be updated so an investigation is opened regardless.

A DSS report shows a social worker confirmed MacNally was abused but indicates the social worker didn’t open an investigation because, the form says, the two employees were fired.
 
Something to be said of the custom some groups had where when you became a burden you went for a long hike or drifted out on an ice floe. I always joke that I plan to crawl off in to the woods and bury myself under the leaves so they can't find me but maybe it ain't such a bad idea

It's something I used to consider too. Take a tent and a rifle into the woods. If I don't make it, that's life. If I do go full Richard Proenneke, that's cool too.
Unfortunately I think my knees are going to ahve something to say about this now, and that's gonna have to change my calculus.
 
I told my son to strap my skis on me and shove me off a cliff or strap me to my motorcycle and do the same thing.
My mom just recently passed. She was in a home for 6 months. My dad passed 10 years ago and was in a home for about the same amount of time.
I visited daily but at different times each day. I never witnessed any abuse but that doesn't mean there wasn't any. Although I will have to say that my mom's caregivers were all great. Thank you Sharon Towers!
The biggest abuse was to their bank account. I thought it was bad 10 years ago but that was nothing like the $10k a month it cost my mom!
It's too bad that families are spread out so far these days. When I was a kid, your grandparents came to live with the family until they died. It's not like that anymore.

Her daughter is the legal guardian Ann's therefore has the legal authority to consent on her behalf.
Same thing when my wife was legal guardian for her mother after dementia diagnosis.

Added note: nursing homes would much rather this not be the case.
My mother in law was typical of dementia. She could not form new memories. So she could never complain about anything that happened the day before, or even hours before.
This is why predators think they can vet away with abusing the elderly.
Every guardian of a family member in a nursing home should home mobile data enabled camera in the room of a loved one in a nursing home.
Sadly, abuse is not rare.

I would kill that evil bitch's entire family and leave her alive. The DA wouldn't fare much better. I am generally the calmest man you have ever met but will burn the world down over my family.

My wife works at a high end care facility and in the past two years she has approved four terminations related to patient care, two of them recently. One woman wasn't giving out medications to any of the residents on her shift. The other three were all sleeping on the job. It really makes me wonder how much crap and abuse gets by everywhere.
 
@wsfiredude what did they do about the Danby House fight club? I think WSPD/they pressed charges and followed up on that one.... @Chdamn , Ill drive you to beat their ass.
