I have a Type 01 license and a friend called me about a gun that a friend of his inherited and it was full auto. His father passed away and the gun was left to the son. I have no idea what it is or who the person is.

My advice was to leave the gun in his father's safe or where ever it is and apply for a tax stamp. Whatever he does he should not take the gun. I think the father's stamp was in the father's name.

Then he asked what could the price be? Without knowing what the gun is I told him anywhere from 15k to 70k. My feeling is that it is an Uzi but that is just a guess.

I have a call to ATF and asking what their advice is and what should be done with the gun until the son gets a stamp.

Any suggestions?
 
Form 5 tax exempt transfer. From batf PDF.

The firearms may be transferred on a tax-exempt basis to a lawful heir. The executor would
apply on ATF Form 5, Application for Tax Exempt Transfer and Registration of a Firearm, for a
tax-exempt transfer to a lawful heir. A lawful heir is anyone named in the decedent’s will or, in
the absence of a will, anyone entitled to inherit under the laws of the State in which the decedent
last resided. NFA firearms may be transferred directly interstate to a beneficiary of the estate.
When a firearm is being transferred to an individual heir, his or her fingerprints on FBI Forms

The executor of the estate can be in possession of the weapon until the gun is transferred to an heir or sold and transferred to the buyer.
If it is a registered UZI then they can expect 12K to 16K as far as value goes.
