Former Rochester, NY Judge who got a DUI & Violated Probation etc etc Goes to Jail

Now former, Rochester NY city court Judge Leticia Astacio, who was elected in 2014 to a 10yr term, has a racked up quite the record since her 2016 DWI arrest and has been in the news numerous times for her pattern of blatant disregard for the law.

She was found guilty via trial and sentenced to the max of 60 days jail time + 3yr probation with conditional discharge. Her attorney asked for longer straight jail time claiming she would not be able to abide by probation. She violated the terms of her probation almost immediately by drinking alcohol, bypassing the ignition-breathalyzer device, refusal to show up for probation, and more.

During her multiple court hearings about the probation violations, she basically made a mockery of the court and was quite disrespectful. This is what seems to have really bitten her in the long run!

Here is a story from April 2018 to provide some background. She was given an $11k pay increase despite her DWI, 3yr probation, and only showing up for work (desk duty) 1 out of 216 days.

In late 2018 she was stripped of her judgeship, when they noted a lack of remorse, lack of respect for the law, and poor judgement.

Last week, she finallllly plead guilty to a single probation violation and was sentenced to 180 days in jail.



The former judge Astacio makes a good argument, in my opinion but it’s too little wayyy too late. The sitting judge in the video seems quite upset with Astacio. I almost wish the judge hadn’t made those comments after Astacio is cuffed because I feel it could be used in an appeal to overturn the sentence. Now I’m not sure if that’s possible but I would imagine so.
Personally, I’m glad to see this woman being jailed for her repeated disregard of the law. In NY of all places, it’s mildly refreshing to see a “person of power” being held accountable.

She clearly has alcohol dependency issues. Cops, courts, and jail are woefully inadequate and unequipped to deal with this condition.
 
She also tried to have a “measuring contest” with a bigger competitor. Her robes weren’t going to be enough to spare her
 
She threw away a career because of being a drunk. I believe that Guilford county had a judge die from a Methamphetamine overdose.



I believe that repeat DWI offenders should be charged with premeditated murder when they kill someone in a crash. The courts are a failure in dealing with this problem and put these multiple repeat offenders back on the streets till they kill then give the a token amount of jail time and their out again.

I’d say she threw away her career not by being a drunk, but by failing to take responsibility for her actions and clearly acting like she thinks she’s above the law.

For example, at her initial sentencing, she tried pressuring the judge to change her sentence stating that she won’t [be able to] abide by terms of probation.

I also watched the NYS Supreme Court hearing where they argued whether she should be removed from the bench. They made it very clear that there are plenty of examples of judges and public officials who got DWI’s but sought treatment, admitted their faults, and humbly showed remorse. It was her pattern of violations that upset the court and resulted in her being removed.
