My BIL wasn’t thinking. He drove up to NJ, got pulled and acted like he would here. Informed the officer right away he’s armed and has his permit.
It just happened in Morris Co, NJ, what’s his next best move?
Who should he contact?

Oh dayum. He should probably start with God and work his way down to a really good NJ lawyer. Maybe tweet the President while he is at it. Hope this doesn’t cost him too much and has no time in the big house.

There’s an firearms specialist attorney in Winston that has tables in most of the area gun shows. Usually he just sets it up, leaves his cards, and goes home. I did chat with him once. If you want, I can try to find his card and maybe he can suggest somebody in NJ. Let me know.
 
Morris County is so close to NYC it almost flows the same liberal way. He is in deep caca and is going to need some major help from that neck of the woods. I hope he was traveling thru and only was stopped for a traffic violation and can try the “Safe Passage” part of a firearm protection part of the Firearms Owners Protection Act Of 1986 but he’d better have had the firearm unloaded and it and any ammo not readily accessible ... which it sounds like he didn’t from the OP. He’s in for a financial hit for sure from legal costs but if he was carrying like it sounds he was he’s looking at a couple charges that could mean jail time.

ETA ... if he was in Newark, Patterson most of the other eastern municipalities he is really screwed. Newark might go for the death penalty ...

Unfortunately, possession of hollow points (which he presumably had) is a separate crime. :(
 
I feel for your BiL and what he's going through. And its not like I've never driven through enemy territory with a gun. But, what the hell was he thinking??

Even Shaneen Allen was in jail 48 days before Christie pardoned her.

It's kind of tough to walk around with a CHP and also be oblivious to gun laws in hostile states. Still, doesn't 1986 FOPA "safe passage" provision protect him? Or was he maybe dumb enough to say where he was heading?

NJ has him though, and even if he gets out of it he'll never see that pistol again.

I'm not sure what the hell he was thinking but when I go see my son in N.J. everything stays home. I even do a search of my car to make sure there are no rounds that may have fallen out of my range bag, etc. I feel sorry for him because he's in big trouble in N.J. I lived in Morris County and I can tell you they don't fool around. He needs to get a GOOD lawyer.

Being from NJ, he is royally screwed! I feel sorry for him as I disagree with the laws but I think everyone knows that the NE is NOT gun friendly. It’s your responsibility as a CHP holder to know where you can/can’t carry.

I would absolutely contact every Repub politician that might have some influence there, up to Trump. He’ll need any help he can get.
 
He'll be lucky if he doesn't get an seriously long extended vacation in NJ. NJ hates people from the free states. Even worse when they have a democrat governor who demands "foreigners" be made an example of.
CCW insurance won;t help because he was carrying illegally in a state that is only friendly to real violent criminals.
 
Evan Nappen is an attorney that focuses on firearms law. He splits his time between NH and NJ and is very active in gun rights. He needs an attorney in NJ.

I had an issue in NH where the Chief exceeded the statutory limit and put an unlawful expiration date on my wife's license. He quoted me a very reasonable fee, but NH law stipulates that the violator pays attorney fees & costs. Personally. I think he just wanted the opportunity to stick it to one more crooked cop.

I travel through The People's Republic of Maryland on a regular basis taking my son to competitions in Pennsylvania, Valley Forge When I go through Maryland, I do not leave the highway to stop for food or gas, because technically speaking under their state laws, they allow transport through their state to ranges where competitions are held, or through the state for non-state residents. The guns must be in a locked in a case, ammo stored separately (also locked when I do it) and in the trunk or out of reach. You don't play around with them. I wouldn't even spend the night in Maryland with my guns if I was attending a competition there. The state laws are too subject to interpretation.

Federal law allows you to transport the weapon, not carry concealed. You have to carry according to local state law, and they don't play.

Pretty sure he’ll need an attorney licensed in NJ.
 
Guys unless a NC lawyer has passed the bar exam in NJ its pointless to give information on NC attorneys. He is better off finding one in NJ that knows their judges and DA's anyway.
The point of posting NC lawyers is to call a NC lawyer’s secretary and ask if they can get a reference for someone in NJ.
