Interaction with rabid (presumably) feline

    When I got to work this morning (office at in-laws), my M-I-L came out asking if I'd seen the cat in the grass.

    Sure enough, there was a small-ish domestic appearing cat just sitting in the grass, meowing. He let me approach him, then he walked/sauntered/waddled up to the driveway area and laid down again.

    I used a stick to turn him over, noticed his balls and assumed since he's a dude, he's not pregnant.

    I load a bolt action .22 and set it by the work van just in case. I had my work gloves on so I grabbed him by the nap of the neck and near the tail to take him to the grass and once I set him back down, he started hissing and doing some crazy dance like we were going to fight it out.

    Then he chilled out and moved towards a close woodline. I figured he had rabies so I mercifully put him down with [1] shot to the back of his head.

    Now, I threw my work gloves away, washed my hands, disinfected the rifle, safe, doorknobs and what not.

    Should I burn or bury the carcass?

    If he had rabies then good on you for putting him down. That's got to be one excruciatingly miserable way to die. But as BB stated above, a shot to the head will prevent any testing for rabies.

    Sadly, I use those same shoes now play in the dirt when grading...

    Looking/acting drunk? Yes. Nothing really to fall over in the grassy area of the yard he was in.

    While I'm not a big fan of cats, that didn't sound like a rabid animal. Yes, I know what a rabid animal acts like.....

    One of our coworkers wanted to get rid of this nasty feral cat, when his wife was out he took one shot with his .308
    and could not find any trace of that cat, just a lot of blood.

    The 3 S"s. Shoot, shovel and shut up.
    You might want to stop talking about it cause unless it has changed it is illegal to kill a feral cat. We had a guy who shot one once on a hunt and the game warden came along and gave him a ticket.

    It’s the government so I believe you, but what can possibly be the rationale for not killing feral cats?

    (b) If any person shall maliciously torture, mutilate, maim, cruelly beat, disfigure, poison, or kill, or cause or procure to be tortured, mutilated, maimed, cruelly beaten, disfigured, poisoned, or killed, any animal, every such offender shall for every such offense be guilty of a Class H felony. However, nothing in this section shall be construed to increase the penalty for cockfighting provided for in G.S. 14-362.

    (c) As used in this section, the words “torture”, “torment”, and “cruelly” include or refer to any act, omission, or neglect causing or permitting unjustifiable pain, suffering, or death. As used in this section, the word “intentionally” refers to an act committed knowingly and without justifiable excuse, while the word “maliciously” means an act committed intentionally and with malice or bad motive. As used in this section, the term “animal” includes every living vertebrate in the classes Amphibia, Reptilia, Aves, and Mammalia except human beings. However, this section shall not apply to the following activities:

    (1) The lawful taking of animals under the jurisdiction and regulation of the Wildlife Resources Commission, except that this section shall apply to those birds other than pigeons exempted by the Wildlife Resources Commission from its definition of “wild birds” pursuant to G.S. 113-129(15a).

    (2) Lawful activities conducted for purposes of biomedical research or training or for purposes of production of livestock, poultry, or aquatic species.

    (2a) Lawful activities conducted for the primary purpose of providing food for human or animal consumption.

    (3) Activities conducted for lawful veterinary purposes.

    (4) The lawful destruction of any animal for the purposes of protecting the public, other animals, property, or the public health.

    (5) The physical alteration of livestock or poultry for the purpose of conforming with breed or show standards.

    Did I ever tell you I used to get paid a quarter a cat by the farmers around me that liked to dove and quail hunt?

    One of them had to make a new rule that I wasn’t allowed to shoot them off of someone’s porch.

    Yep. Same as neighbors dog coming into your yard. You can kill it, but you can't chase it off with a bbgun... Because that's cruelty :rolleyes:

    Then why do farmers still need a depredation permit to shoot deer causing crop damage?

    I had a friend who ran catfish ponds. They regularly shot Blue Herons because they stood all day in the ponds eating cat fish. He still had to have a depredation permit to shoot them. Don't think they are considered game animals.

    The reason the permit is needed for blue herons is because they are a protected species under the migratory bird act or something like that

    Correct, even NC State Fish Hatcheries have to obtain a permit to shoot Blue or Green Herons.

    We had an outbreak of distemper or rabies in foxes and racoons on Oak Island several years ago. We had a small coon hanging around the house that was obviously not in a good way. It eventually had to be shot by a police officer. I asked the officer whether they tested the dead animal for rabies, and he said they did not unless someone was bitten.

    I also asked him if I could just have shot the animal myself. He said that I could not because there is no shooting allowed on the island. That shooting prohibition includes everything from guns to slingshots. He told me that I could either club the coon to death or stab it with a spear.

    Good OKI info, I been plotting how to harvest some of those big ole fat squirrels down there. A slingshot was my first thought. Now maybe my Cold Steel blow gun?

    There is a bunch of squirrels here. I love to eat squirrels. I might have to eliminate a few when the fall comes.

    Thanks I guess for all the potentially related legal ramifications.

    I have not qualms or regrets about taking him out. He displayed rabid (in my mind) behavior, my children play outside at my in-laws quite a bit, so for my immediate and their future protection, ole crazy cat got the permanent treatment.
