This is another crazy story.

NC man builds a crude shotgun out of pipes. The "shotgun" shoots 12ga shotgun shells. Obviously this guy is crazy. He already admitted that he built it and traveled to Seattle to "kill all the cops". Luckily he failed and no one was hurt.

But, he's facing federal charges from ATF&E for "building a destructive device" and faces 10 years in federal pound me in the ___ prison.

He's a crazy person and deserves to go to jail.... I get that.

My question is, where do the alphabet boys draw the line between someone legally building a homemade shotgun and someone building a "destructive device" that shoots shotgun shells and will get you sent to prison?

AHHHHH. I didn't think about barrel length or overall length! I bet that's what got him.

The whole "device" was probably only a few inches long so that he could conceal it in his pants pocket... Like a homemade 12ga derringer...
 
There are a lot of technicalities, but basically if it's not a set type of shotgun (made to be shouldered, barrel 18" or greater) and fires something larger than .5" in diameter it runs into NFA rules.

EDIT: there are special exemptions in NFA law for shotguns as long as they fit the criteria.

Then there are "firearms" the don't fit into any of the classifications.
V3 TAC 13 is one.
12g, no pistol grip. No butt or wrist brace.

A ā€œbang stickā€ is a destructive devise? Donā€™t really have mental energy to think it though or look into exactly what he made, but if itā€™s a bang stick itā€™s basically a contact ignited mechanism with fixed pin at back of a pipe shorter than cartridge itself...

scuba divers use them for self defense to my knowledge.

before yā€™all wonder WTF I am so familiar with such an odd device, thatā€™s because I looked into it when used in the superb Ton Clancy novel ā€œwithout remorseā€...

And then there are some with a pistol grip, and a wrist brace...that fire shotshells...yet are still not in any of the classifications. ;) :cool:

Yep... I've been a certified open water diver for 26 years. I always wanted to kill a shark with one of those bang sticks...

Sadly, I haven't been diving since 2005 when I dove on a coral reef in GITMO. I miss diving, but I don't have any gear and don't know where to go diving in NC.

destructive device would be a weird classification for one (again though Iā€™m not familiar with exactly what was built by protester) as itā€™s likely not much more than a scolding factor on land.

As you are likely aware, and more mechanically minded Gun owners would intuit, firearm cartridges are engineered to function in high compression environmentā€”which air not confined to a steel tube does not do well. And while water dissipates energy too much to have any ā€œballisticā€ effect, itā€™s density makes for a gnarly pressure cavitation that will destroy flesh in very close proximity.

I doubt that a bang stick is classifiable under current laws since it does not contain a barrel.

This website sells bang sticks and interchangeable power heads in many calibers for use as shark protection, alligator hunting, or hog hunting.

About $140 for a stick and a power head in your favorite caliber.

I wish we could stop wasting taxpayer's money by keeping these idiots alive in a cage for 30 plus years... Too bad we can't get back to the days when people were tried and executed in a more expedient manner...

Out of Morehead city is the place to dive out of. Alot of wrecks. Sadly I haven't been diving in yrs either and not expecting too.:(

I have a powerhead chambered in 357mag. Originally it came as a breakdown 2 piece bang stick about 2 feet long. But it's threaded and I currently have it mounted under the spear of my 48" speargun.
I've never had to pop a shark. A poke with the pointy spear tip and they dart off. But I've had to pop a few barracuda..they swim right up to your face fearless as hell and then dart away at the last moment. Scare the crap outta you. Oh hell no homey don't play that game.

In Florida, bang sticks and powerheads are illegal to hunt with. But you can use them for defense;
Me- "I was in fear for my life so I shot him!"
Marine Patrol- But Sir, that's a 30 lb grouper. They're harmless."
Me- "he was coming right at me I tell ya!"

Destructive device because bore is over .5ā€ diameter.

But there are exceptions for shotshells used for sporting purposes.
