I can also inform him the US law requires that all pay, and accrued vacation MUST be paid on the last day of employment. (Sure, we know that very few US companies actually follow this law. But I can scare him a little.)

I had never agreed to those conditions during my 12 year tenure. This blew my fuse and I lost it.

I told the minion, "I'm still your boss and here are my last instructions. First, call the company's local attorney and ask him to explain US and NC law with regard to employee payments. Then, roll up that document and shove it where the sun don't shine!!!" :mad:

In general, non-compete clauses are unenforceable if they prevent you from working. I can only not work for a company based in China. But even China doesn't enforce that. But that is why, in China, everyone leaves to help with a family business.
When I was laid off from a previous employer, they withheld lump some severance package unless I signed away my right to sue for age discrimination. Seems all employers now do this for anyone over 40. Of course, over 75% of the people laid off were over 40. 50% were over 50.
 
Years before that resignation episode, somebody showed up at my office in Italy with a non-compete for me to sign. It seemed someone had realized that managers didn't have such a clause in their contracts (I never had a written contract). I told the person I'd never sign such a document, given that the company had never agreed to commit our relationship to writing. I also explained such an addendum would legally require compensation to me and I was ready to hear their offer. I then asked the person to find me boxes large enough to pack up all the personal stuff in my office. :p
 
Be sure to drain what is allocated to a flex spending account if you have not done so already. Got Rx eyeglasses when I bailed out from my bank job years ago.

Background investigation completed. Just waiting for NG management approval. Saw the report. No surprises other than they put an alias with me using my wife's last name. Weird because I have never used her name for anything.

Chinese companies do contracts but then they always write them such that they never have to honor them. Always have an escape clause built into the wording.
Exactly what I would expect dealing with a Communist in Any deal. Oh yeah...and I ain't goin!!!!!!!!!!!

By the way, because I still didn’t trust them, I insisted on (and got) a bank guarantee that forced their performance.

What my employer did was make the first raise contingent on releasing specific product. Then never had me work on those specific products. When no raise came they said I didn't fulfill the contract. Didn't matter that they changed my work projects.

Yeah, I’ve been thru that kinda crap too. One year I worked my ass off and dramatically exceeded the threshold for a significant bonus. When the payment arrived, it was next to nothing. They had a metric that considered bad debt write offs. Because I had otherwise earned such a large bonus, they chose that year to write off uncollectable accounts going back to before I was with the company. :mad: That’s just one episode in my education.

He is in meetings dealing with a supplier/customer. He might not even know yet. But just about everyone else does.
One person said it is bad for the company. Maybe. But the rulers in the company are the real problem. Rulers, not leaders.

The feeling would be good, but not a good idea as I'm sure most agree on. You just might cross paths with them at one time, or you get knifed and it gets back to your new company.

I like the recording idea. If they talk it's implied consent. Best to get out ASAP without talking.

Out of curiosity, where is this Big Boss located? I thought they were in China. If do, I seriously doubt you'll talk face to face ever again.

He is actually a naturalized US citizen.
I technically work for the wholly owned US company.
He was planning to come to deal with bank issues.
I simply made sure he is anxious as hell on the flight over. Ha!

I'm hoping that once he accepts that I'm not staying he decides to end my employment by this Friday. Then I can start a week sooner.
I'm still concerned he will try to steal 2 months of pay by claiming he doesn't owe any vacation time.
Nothing in the contract has any conditions he can claim allow this. I kept my records.

It's really not contractual, it's labor laws in the state that you pay taxes.

I know as I explained what I once went through with the NCDOR. The response was "honey let me take care of that for you". 3 weeks later, a check.

See post 161. Tell him, with a smile on your face, that you hope it won’t be necessary to involve the government to enforce law with regard to amounts they owe you. You’d feel just terrible having to resort to that very viable option because it probably won’t end well for the US arm of a Chinese company. :D
