New law passed concealed carry

The attachment of the fix NICS added some little nuggets that could add some to the no go list for things like forgotten out of state traffic tickets and such. Things like that could screw up CHPs since a NICS check is run for that also. Rolling these two into one gave anti-gunners a win either way ... it passes they get the fix NICS nuggets or if it does not pass they stopped National Reciprocity.
 
CNN does have a liberal click-bait title "House passes bill loosening gun restrictions"

It could just say something like "House passes bill requiring states to honor the constitution" or some such. :)


Even if it passes, it will take the restricted states zero time to shove through a bunch of new CCW laws where their permits are considered "enhanced" permits or some such and everyone else's are "normal" permits, then make restrictions on the "normal" permits like "no carrying where more than 1 person is present" or "no carrying in any building unless explicitly posted that tis' OK", etc, etc.

 
Also IF is passes both the House and Senate AND Trump signs it ... NY, CA, MD and others will take it to court as a violation of States Rights and that filing would be someplace like the US 9th Circuit which would be a guaranteed win for the them.
 
I don’t eve like having to deal with the sheriff I sure as hell don’t want the ATF involved in my EDC.
Yep. I haven't read the bill, but if it involves federal control of the permitting system, that's not a good thing.

And if it doesn't? If it is as simple as saying a permit in one place is recognized as being valid and equivalent to a resident permit in another?

This stuff about the ATF now issuing or being involved in permits is FUD.

I wanna take a real close look at the wording. I haven't had time to look it up online, so if anybody has the link to the bill, I'd appreciate it if you'd post it.

As originally written by Richard Hudson, HR38 would have been fine. I think all he was trying to accomplish was to standardize the law across the country or at least the states that have reciprocity. So for example, when on a road trip through multiple states, you didnt have to be concerned with what the law is in this state, and then the next state you enter into, and so on. A standard set of rules. And maybe also he was trying to get all 50 states on board.
But then the Vegas shooting, then the Texas church shooting. Then it was discovered the Texas shooter acquired his weapon legally, passing NICS,
because....he wasn't in the system because....for whatever reason, the AF didn't report his criminal behavior while enlisted.
So the anti's came up with the "Fix NICS" bill, so they can get you on the "List" for something as simple as an unpaid parking ticket.
I'm not sure how but Fix NICS has now been tied to the original bill and it's gotten really complicated no matter if you're a 2a supporter or not.
I was onboard in the beginning with the original language in the bill. Now, I think its doomed.
I don't get any of my info from TV or web. Mostly from alerts I receive from 2a organizations.

They are going to keep playing with fire until their tails get burned. Then we will clean up Washington and start over.
 
State law over Federal any day. If the fed wants to be involved and make reciprocity the law of the land, they can start by declaring that any state law that preempts "must issue" is unconstitutional. That is how you do it, not more laws on top of laws. Pretty soon owning and carrying a gun will be as simple as filling out your tax returns!

As much as I want it, this is not consistent with my interpretation of federal powers when it comes to states rights vs. the federal government. I don't know if this is the proverbial "camel's head inside the tent" or not. An argument can be made that this has been the case since the early 1900s, but if that is the case, then this could be a step down the slippery slope.

I want it, but I won't be breaking open the Champaign if it passes.

If NY, NJ, CA, etc doesn't want to accept a permit from another state, that state doesn't have to accept reciprocity with that states drivers license. They want to restrict my travel with a gun, restrict their travel with a car. Cars kill more people than guns anyway.

I have a beef with this.

Several states already tie their concealed carry database in with the DMV database. Run a license plate on a vehicle, and they know if the person that vehicle is registered to has a concealed carry permit or not.

I don't like that on several levels.

And I don't want to mix rights with privileges. The RKBA is just that...a right. A driver's license doesn't represent a right...it's a privilege.

What we need is for the legislatures in this country to stand up and say "The Second Amendment IS THE LAW OF THE LAND and the federal, state, and local governments are bound by it."

Note that I said the GOVERNMENTS are bound by it. Not the citizens, who already HAVE the right to keep and bear arms.

I know what you are trying to say, but I tell you, it will be a red letter day when the 9th circuit rules in favor of states rights. This one might just cause some liberal heads to explode.
 
And there is also another bill that was introduced into the senate on 2/27/17. It's S.446 if you want to look it up.
The Constitutional Concealed Carry Reciprocity Act of 2017, written by John Cornyn (R) Texas.
Who has in the past shown to be a strong supporter of the 2nd amendment I think.
This went to senate judiciary committee and that's where it is still today.
I'm not sure the differences, or why Richard Hudson's bill was more popular and received more sponsors.
And oddly enough, John Cornyn was quick to jump on the Fix NICS bandwagon.
 
It seems like hr38 left gfsza unchanged, so it is still 5 years in prison for concealed carry within 1000 feet from educational property line unless the license is issued by the state. No exception, say, to drive interstate. I know many locations at i95 in nj and ny that are within these limits.

I don't understand the issue of the Feds telling states to play nice and let everyone exercise a right that others are allowed. As someone who recently traveled all up and down the eastern seaboard, I'll tell you my biggest fear was being pulled form the car kicking, screaming, gouging, and ripping by some over-zealous NY, MD, MA, MD, [insert any particular state flavor here] cop, just for having a gun in the car--stowed as "properly" as I could/knew how for each particular state.

I don't read anything about the ATF having their hands in this, nor of them keeping a database, nor any other freakout-worthy "gotcha."

Now the NCIS thing...I don't know. I haven't read it yet. My gut reaction is those saying a parking ticket will now ping and keep you from getting a gun and/or CHP, I'm betting you're likely (hopefully unintentionally) regurgitating false sensationalism. If I'm wrong, please quote the bills directly to show me otherwise.

To me, this is where the Fed should step in to tell states to knock of their petty BS and acknowledge one another. The bill clearly still allows states to decide if they even have a CHP. So if they want to be utter shut-ins and not play with anyone, they still have that state right.

I'm not busting anyone's balls here. I'm just asking that you take time to read the black-and-white text before making a hard-nosed decision.

I just don’t want concealed carry to become a privilege anymore than it already has. Of course I might be the crazy one considering that I believe that all firearm regulations is unconstitutional according to the second amendment. ;)

" fix nics bill", so hopefully they'll both fail. It was originally a D sponsored bill.

That would be me regurgitating. I did read the text and like most other legislative text it is hard for me to decipher. So I relied on second-hand info.
As I was told, it wasn't exactly the parking ticket that would do it. But instead a warrant for arrest that was issued for an unpaid parking ticket, speeding ticket, Failure to appear...which would make you a fugitive from justice, which "Could" get you on the banned list. Also I was informed that a certain state had already turned over many names of people in that exact circumstance, only to find out that appears to be false as well.
As a matter of fact, if I am to believe the Washington Post article in front of me, dated Nov 22, by Sari Horwitz, it seems as though just the opposite has happened with regards to fugitives from justice. And this story also lends itself to the creation of the Fix NICS bill.
