I have an NFA trust with a couple of items currently in it. The lawyer who setup and managed my trust in the past has passed away. I need to make some amendments to my trust and would like to use a lawyer. Does anyone know of any lawyers in Wilmington who do this sort of thing? I looked around online and there are a couple of potential options, but I haven't found anything local. If anyone has any suggestions, especially if it's based on firsthand experience, in the Wilmington/New Hanover area that would be greatly appreciated.

If not, here is one option I'm looking into: http://northcarolinaguntrust.com

Just wanted to point out there’s really no such thing has a “gun trust”. There are trusts that hold guns, but they’re really not any different than a “regular trust”.

I say that as a person that paid the hundreds of dollars to have one set up years ago. There’s a lot of NFA related language in it, but it’s almost pointless. It mentions needing a 5320.20 to travel, which is required regardless of what the trust says. It mentions filing the proper paperwork to transfer items, which is also already required. You could remove ~40% of the wording of my trust and nothing would actually change, as it’s already covered by existing regulations.

I just say that to say find a good lawyer, but don’t limit yourself to those that advertise as gun lawyers. I’d bet a majority of what you want to change can be done by any competent lawyer.

When I wanted a second trust, I opted for a $49 online version instead of a $400 local guy.

I was thinking to do something similar for FORM 1 items going forward. I currently have: H****** REVOCABLE NFA TRUST AGREEMENT
Fine for buying things, but a pain in the butt to worry about engraving in the minimum size requirements.

I’m also looking at doing a trust from thetrustshop.com for $49. But I have a question. Can you amend these thrust to add for other items to be placed on them? How difficult is that. Or are you getting a different one each time. For 50$ it’s not going to break the bank setting up a new one, just curious

Instead of Schedules, this one uses Assignment of Property sheets. Every time you add something, you can fill one out.

Thanks for the advice! I appreciate your perspective, especially as someone who clearly plays in the NFA arena as much as you seem to. I pay for a lawyer for the peace of mind. I'm not a lawyer, have no experience with managing or establishing trusts, and don't have much desire to do so. I know a bunch of people who do their own trusts and it seems to work out for them, but if the ATF ever comes a knocking, I want that pre-established relationship.

The reason I asked for lawyers that advertise "gun trusts" is because I've called multiple lawyers who do manage trusts but who stated they couldn't or wouldn't do a trust for NFA items and guns. I had the same issue when I was first trying to setup my trust and purchase my first suppressor. I've yet to find a "normal" trust lawyer interested in doing such things.

You could just ask for a trust. And instructions on how to add items (usually Schedules or AoP sheets). They have no reason to know what you’re putting in it. Start with a dollar bill since it has a serial number. That’s how most “gun trusts” are initially funded.

Whether you include, or don’t include, all the NFA language in the trust itself doesn’t change the fact those statutes and regulations exist.
