NICS checks for non citizens - delay?

Hey all, any non-US Citizens - what's the deal with NICS checks? Should a non citizen expect a dealy?

I've only bought handguns with pistol permits and CHP, so have not had to go through a NICS check yet.

There is not a delay unless something about you matches someone else like you that did something bad and they have to make sure it's the right you. You get it. There is no standard delay. Hint give as much info as possible to avoid delays, people that leave off ss#'s get delayed more often.

I have a completely odd real name (Google it and it's apparently just me) and a valid US residency and I still got a delay every time. Wasn't always like that, just since 2010 or so. So yes.

A coworker asked me about a delay for a gun purchase just last week. He said they held him up because his drivers license did not have a "star" on it?
I am not sure what the star means.

So, reading the "Firearms Laws" document at www.ncdoj.gov - it's possible to use a CHP as an alternative when buying long guns, I knew it could be used as an alternative to the PPP for handguns, but looks like it can be used as an alternative to NICS for long guns as well.

Anyone do this, or do most LGS just go the NICS route anyway?

Depends. In NC most stores will accept the CHP in lieu of a NICS check because they can and it's easy. If you're buying your long gun in another state they cannot accept your NC CHP and will have to run a NICS.

I think you can use a PPP for up to three longs guns (purchased at the same time)? Instead of the 1-for-1 like it is with handguns. ETA: the document linked above just says "multiple" long guns purchased at the same time...not sure if there's a limit

I've used my CHP for pistols, long guns, and NFA items. Honestly not sure I've ever had an actual NICS check run.

It was delay all the time for both, me and my wife. However, I can't say whether anything changed after naturalization because I've got my CCW while I was LPR. That was one of the major reasons to do that. Sure, you didn't have to go trough NICS since I've got my CCW. It works for pistols, long guns and NFA items. The only place where they didn't want to take CCW was Dick's but the name says it all. Never buy anything there. :)

At Walmart we will skip NICs if the transferee provods a CHP.

I see lots of delays at work with zero rhyme or reason to how long the fbi takes to get back with us. The shortest delay came back the same day in about 5 hours and multiple delays have lapsed at the 30 day mark. It all depends on who gets assigned the delay on the other end.

Doesn't NICS still have 3 days to give you an answer?? I never heard of the 30 day mark.

IIRC 36 hours for the ATF, then the FFL is clear to sell the gun. But I know guys that are just turning down delays that lapse. Too much liability. But what they usually do with a delay is inform the customer of how to get an ATF pin number to stop the delays. Usually a delay is because of some similarity between you and a prohibited person. With the pin number you can prove who you are regardless of problems that might cause a delay. IIRC the FFL uses the pin when they call in the NICS check.

Walmart, like most big box stores, will only sell the firearm with a proceed.

A 4473 is only good for 30 days. So if we don't get a response in 30 days it's treated as a void and the paperwork needs to be done all over again.
