My Guess is a modified
Phoenix Arms HP22
 
I looked at that video frame-by-frame and while it's very fuzzy you can make out a *TINY* flash of silver as it falls from his pocket. The story states that it's a 22 and we know it fired when it hit the floor. I'm going to speculate it was a NAA 22 that was not carried in a safe condition (hammer in a safety notch).

ETA: I don't own one of these to check it myself but I just watched Hickock45 load one up with the hammer resting on a live round.

As long as the careless shooter was here illegally, had a criminal record, stole the firearm from a Park Ranger, and the victim died in her father's arms, I don't see any reason to be upset with him.

Maybe a few months in county, then turn 'im loose in a sanctuary area.

The guy wasn't charged though... and he was from across the bridge in NC.

Actually, I found it refreshing and open minded that he wasn't charged. Otherwise, it's anti-2nd, gun fearing reaction, demonizing gun owners.

So if some moron drops his unholstered gun and it shoots you in the leg can you "accidentally" shoot him back. I have one word for this and traffic crashes, RESPONSIBILITY!

Here's your what if for the day. I often carry in my back pocket, in a holster. Let's say it goes off. Not sure how it could but let's say it does. I fall down or something. Should I be charged? You may think carrying in a back pocket irresponsible, I don't anymore than you carrying kidney is irresponsible yet your trigger could get caught on your shirt and fire. Plenty of people carry in their front pocket, that irresponsible? They are called pocket pistols for a reason.

Well, how about discharging a gun inside a business for starters? And at the minimum he should be charged for being a dumbass. What if it had hit the guy in the head or femoral artery or hit the baby in the high chair at the other table. Oops I'm sorry just doesn't sit well with me. If you are going to carry a gun, you need to be responsible for every bullet that comes out of it, even "accidental" ones. I hope the guy that got shot sue's the pants off of Mr pocket carry with no holster. Stupid is as stupid does. He needs to pay dearly for that stupidity. Maybe he will learn something from it?

Carry however you want, but if you "accidentally" shoot someone, you should be held totally responsible for it. If you get shot at lunch tomorrow by some dumbass like this are you going to look at the guy and say, "No problem dude. Don't worry about it. It was just an accident?"

If no crime was committed, why was the gun taken for evidence?

Unfortunately, there's not a law against stupidity and just as unfortunately most of us have done stupid things. And will likely do more. ;)

You've been implying that he won't be held responsible though you have no grounds to think that. He can be held civilly liable if he doesn't take it upon his self to make it right. Dropping your gun doesn't rise to the level of a criminal act no matter the damage done. That goes for the FBI agent too but the powers that be felt that they had to make an example out of him.

When being a dumbass becomes illegal I know a lot of folks that will need to keep their heads down.

Wanna bet the restaurant owner is, at the very least, considering gun buster signs now? What about the neighboring business's? What about his pals at the Chamber of Commerce?

@SPST , it seems most of us agree with you that Shootie McClusterphock is and should be held responsible for his carelessness. The disagreement is whether "being (held) responsible" and "being criminally charged" are the same thing. I don't think they are, and like @georgel , I find it refreshing LE did not see the need to bring charges.

The civil suit is a sure bet; there ain't a chance he's gonna walk away from the guy's medical bills and a hefty amount of compensatory damage $.

I'm damn glad no-one was killed.
