Finishing an AR9 build from Palmetto glock lower and 4" upper w/ 2" KAK can from their pre-Christmas sale. I have a SIG brace but have read recently that if I shoulder the brace then I would be breaking the law. I have a valid CCW and most of my shooting is done at a public indoor range that I am a member of so don't want to open myself up to having "law issues". My question is can I shoulder the pistol with just the buffer tube, or cannot shoulder it at all. Is the shockwave treated the same as the sig brace in that it can't be shouldered? Just file SBR paperwork and put whatever stock on it I want when approved? As always, I appreciate all feedback. Thanks.

I don't believe you can shoulder anything built as a pistol or has a barrel length of less than 16".
Shockwave treated same as SigBrace.

I may be incorrect though.

The law is unclear, and guidance from ATF does not carry the force of law. If you want to avoid any possible problem either don't shoulder it or file for the SBR.

I believe you are correct. This is what pisses me off...ATF making rules that have ABSOLUTELY no effect on "gun violence".

Don't shoulder= Legal

Shoulder= illegal

This is as a pistol of course. If you have your SBR tax stamp...you can do whatever you want.

I don't want to get into a pissing match about it, but "illegal" is not the proper term. ATF has issued guidance, that is, their interpretation of the law, but they are not the courts and their interpretation only matters if it is backed by case law. Sure you could be arrested by an agent based on their guidance, but you could also be arrested while following their guidance.

I always suggest that that people follow the law to the best of their ability, but as a group owners of NFA registered items seem to be in a huge rush to interpret restrictions as broadly as possible and give ATF more power.

I don't shoulder mine but it just so happens that my cheekweld is very close to my chest...

Haven't shot it yet but it feels pretty robust, in auto mode the reticle adjusts to the light. Battery is supposed to last 5 years
