DEPUTIES: Homeowner shoots person accused of breaking into car

Deputies are investigating after they say a homeowner shot a person that was reportedly trying to break into their car.

The Martin County Sheriff's Office says they received reports of a shooting on Bailey Road around 12:15 a.m.

Deputies say a homeowner reported seeing a person breaking into cars in their driveway. During a confrontation, deputies say the homeowner shot the person once.

That person was transported to Martin General Hospital by Williamston Fire/ Rescue and then airlifted to Vidant Medical Center in Greenville.

The names of those involved are not being released at this time.


I will update as more info comes available. This occurred only a few miles from me.
 
Defending property with lethal force is a big no no, and I foresee lots of legal problems for the homeowner.

Possibly so. Make the thief think twice next time for sure.
 
Agreed, unless homeowner can make the case that the intruder was in his curtilage, he is legally exposed. I don't recall anything that gives him any extra leeway in a state of emergency, either.

And to think he could have avoided all this if he had just listened to Joe Biden and fired a shotgun into the air.

I'd bet that, if conscious, they are now seeing their decision to violate the property rights of another as a poor "impulse buy".

No, I think he just went out to tell him to get lost.... And then the burgler threatened to kill him with the object he was trying to break in the car with. Uh... Yeah. See.
If he had an item, that'd sure as hell be my case. I went outside to confront the guy, he threatened and started to approach me with some object. It was 12:15am, I couldn't see what he had and I feared for my life.

One only need fear serious bodily injury (in NC). Any adult (lacking a physical disability) is capable of dealing serious bodily injury with their own physical person. If a perp is willing to break into a car - a physically violent act - it is reasonable to suppose that they are willing to do violence to my person and my fear is rational and proportionate.
