VA disability rating and Knee replacement

I will soon have my right knee replaced (using tricare) Does anyone how will that affect my VA rating I get 10% for that knee 20 % total disability fro both knees I am also USN retired so the disability comes out of my retirement check

It could, but as far as it taking the rating away, which is what I thought you meant, it shouldnt
 
Just don't assume it'll go up, my headaches got worse and I had them reevaluated and they took the rating from 30 to 0
 
It’s going to depend on several factors.
Why is it being replaced?
Does the replacement cure the original injury?
Does the replacement lead to a secondary injury? (Time will tell on that one)
Does the scar heal properly?
I’d the car painful and tender?
How much of your thigh bone and shin bone are being removed?

All these moving parts.
Get yourself a VSO.

Lots of orgs to choose from. DAV, Order of the PH, Amvets, American Legion, VFW, etc. Not to mention they are also employed by the state. So if one vso sucks, find another, preferably one that is accredited.
 
'The' DAV guy is purported to be the guru of VA claims/appeals, yet all he says is for me to get the doctors to use specific verbiage about whether they felt my 'condition' was related to reported military activities & the degree to which it caused/aggravated/etc. Trying to find a doctor to give a legit, no BS opinion like that is worse than pulling teeth & good luck getting one to fill out a VA disability questionnaire.

Icing on the cake was I had a meeting scheduled with the 'guru', had to take a day off of work & the MFer was over 15 minutes late to our 1030 appointment, his first of the day.
 
If you are already service connected rated for the knee being replaced then you will be rated at 100% for the first 12 months after the surgery.
After 12 months you will be re-evaluated with the minimum new rating for a knee replacement being 30%.
As your other knee is rated as well you will get a higher total rating as the condition is bilateral.

Yes I am rated 10% for each Knee. The DR took Xrays of my Knee as asked how I walked without painkillers as it is bone on bone on the inside and bowing to the outside leaving a big gap there
 
Go to the VA Hospital/Clinic in Kernersville. No appointment required to see VSO. Sign in and wait your turn. My last weight was about 1 hour. Go early if you can. When you sign in the times listed on the sheet mean nothing.

that's only a 4 hour 45 min. drive each way

Sometimes it takes that.

I worked a 12.5 hr night shift, drove 2 hrs to a VA appt, spent 3 hrs at the clinic, then drove 3.5hrs home, got 2hrs sleep and went back for a 2nd 12.5hr night shift.

If you want it. Make it happen.

As you are already rated by the VA for the knee being replaced you really do not need to see anyone.
Go on-line and find the VA 21-526EZ form. You can fill it out on-line and them print it out to mail it into the evidence intake center in Wisconsin listed on the form.
Along with the form you also need to include a copy of the Dr.’s notes pre-surgery describing why the knee is being replaced and the post-surgery notes describing the actual surgery along with paper copies of the x-rays post-surgery showing the new knee.
If you do get denied for any reason which I don’t think you will since you are already rated, do not appeal it, just file another claim. This is much faster than appealing.

A friend of mine just had this done at Durham VA. He was told to report to Duke and then they did the surgery due to the team all being part-time VA doc's. FYI

as a retiree who has met his $3000.00 cap for this year mine is being done by a civilian doctor in Elizabeth city
