My son just turned 18 I bought him a Glock 43x. I have read that he can open carry at 18 does anyone know for sure if that's right?
 
Open Carry is a right but acquisition is a privilege granted by the sheriff. or you might say, a right held hostage by the sheriff and sold for ransom.
 
If you "gave" it to him he has to have a purchase pistol permit issued by the local sheriff, If not you are both violating state law, whether right or wrong you are still violating the current law.

As mentioned get to know the open carry laws. For instance you cannot open carry in any establishment that serves alcohol for consumption. You can conceal carry as long as you are not consuming.
 
Yes, you can open carry at 18. You can buy a pistol at 18 with a PPP from a private seller, not an FFL. Technically, for you to give him the gun, he needs to get a PPP.
When my daughter turned 18 she went to the sheriff's office and got her PPP in 3 days, brought it home and gave it to me. I put 5 pistols on the coffee table and told her to pick one. She carried everywhere she legally could until she got her CHP.

Did the alcohol thing change recently? I took my chp class about 4 years ago, and the instructor said you can concealed carry into a restaurant that serves alcohol, but you cannot drink alcohol... Then he said, if you take off your jacket, and your handgun becomes visible, outside the waistband, then you can legally drink alcohol while open carrying.

He stood up and took off his jacket, smiled, and made a joke about how stupid it is that you are allowed to drink while open carrying, but not while concealed carrying.

I know that instructors are human and they can give inaccurate info... So, I'm not arguing with you. Just asking if he was wrong, or if the law changed.

he needs a PPP for that too. "Borrow" falls under "receive" does it not?

It is unlawful for any person,... to sell, give away, or transfer, or to purchase or receive, ... any pistol unless: (i) a license or permit is first obtained...

Your instructor was wrong. You have never been able to open carry anywhere that sells alcohol for consumption onsite, eg bar, restaurant. When the law changed a few years ago about concealed carry in bars changed they added this one to prohibit open carry.

Here is another statute on open carry and parades, etc.

I really don't know if it does or not. When it's come up before, the predominate thinking on here was that it did not. If it did, then you couldn't hand your pistol to a friend at the range and let him shoot a few rounds. I'm sure there is something in the statutes that defines what constitutes "receive"; is it a permanent transfer like a gift or does it include loaning the gun to someone for a period of time? I tried looking it up in the statutes but didn't have any success.

@rodney1968 , I think it's great that you are bringing him up to appreciate firearms for what they are, and that you feel confident enough in his judgement to give him one.

But please, please, make sure he knows that carrying that thing to school or college is a felony. This includes leaving it in his truck. It includes picking up his younger sibling in the car pool line at her school, even if he never gets out of the car. Some of these other violations might be just a slap on the wrist, but this one is huge and would affect him for the rest of his life. And if one of his teachers sees it or hears about it, way more of them will go ape-s*** crazy, set off the alarms, call a lockdown, and send out the SWAT team rather than tell him to leave quietly. He will not get any breaks.

Thanks, I have been teaching him firearm safety and shooting since he was around 10 years old.
we are going over the carry part hard right now that's why I asked about him being 18.
I trust him completely with a gun or he wouldn't have any.

Not sure if anyone mentioned this upstream but SC is off-limits for open carry at any age.
 
I tell people there are 3 things you need to know about open carry.

Know the law.
Know the law.
Know the law.

In any situation you are in, you want to be the person that is positive about what the law says. Because the people you are dealing with will not, that probably includes most LEO's and nearly the entire public. And being wrong carries some steep consequences.

You don't need a pistol purchase permit if it's a private sale at least in NC not sure about our commie... I mean weird cousins from the south.
