ATF Shows Up At People's Homes To Confiscate Rare Breed FRT-15 Triggers

Here's some more wrinkles:

1.) Rare Breed is not arguing that machine guns are an unconstitutional thing to ban, a-la Bruen. They are arguing that Rare Breed is not a machine gun, a separate issue? Why is that? Simple. This trigger was made to skirt the NFA. If the NFA is abolished, no one will buy this, they'll just buy auto sears. They don't want the NFA overturned. Not saying they're not right to fight to get their trigger protected, just pointing out this nuance. This might not be the case you expect it is...

2.) Rare Breed is also suing Big Daddy Unlimited for patent infringement for their knockoff trigger. BDU just filed a brief saying that the FRT is a machine gun.
Which of course begs the question, did they knowningly import from overseas their knockoff 'machine gun?'

So yeah, BDU sucks.

1) Is BDU saying BDU's FRT is also machine gun, or just that RB's WOT is a machine gun?
There are a couple of slightly different mechanisms out there. If they can argue that RB's is a machine gun but theirs is not... the patent infringement case is that much easier for them to win.
2) Remember, what they say doesn't have to be truth, just convincing to the court. For all we know they could have worked out a deal with the ATF to limit their liability as long as they throw EVERYBODY else under the bus.

From what I understand, they bought and were reselling frt triggers.
While doing that, they reverse engineered it, had someone overseas make clones of the frt, and then imported those and dropped frt. So, scummy practice.
Frt saw that bdu's trigger was a clone, and sued them for patent infringement.
Bdu now says that the frt trigger is a machine gun, and that you can't have damages for something illegal.
The unwritten subtext is that the new trigger they imported, being a clone, is also illegal.

Yeah, I think they figure they are losing their business either way, why not try to beat the litigation. Scummy all the way around, and I don’t think they can avoid liability for patent infringement. There is nothing illegal about the product itself, even with the most extreme interpretation. It may be illegal to make them without permission, and it my be illegal sell them to certain folks without going through a process and collecting a tax. Also interesting that they admit to their wrongdoing, they surely have cut a deal.

Bdu being shady? Who ever saw that coming

According to BDU themselves, they say all these rumors are untrue. That they don’t think the frt is a machine gun, just that they were quoting an ATF cease and desist order in their court response. They say they’re actively fighting the ATF on that determination.

Is this backpedaling after being outed for their previous actions? Or did they have that position the whole time

There's nothing in the Constitution about "machine guns" that makes them illegal. In fact, I'm pretty sure the Second Amendment pretty much makes what the government did with the NFA unconsititutional.

But that's my opinion on the matter. Because I can read. And the words aren't big ones. Or in Latin or Greek. So what do I know?

Matt Larosiere of FPC has a brief video out concerning the recent court filings. Seems like there is some bad analysis of this flying around.

Bad gas travels fast in a small town (said as someone that originally shared the misinfo, oops).

Yeah, would never have bought one of those on a card. Had they been in retail outlets I would have loved one.
there were a couple people buying in quantity and selling for cash on here. look 'em up if you're still interested. they might have a spare.

Why’s that?

after crump rushed to report insider information about rarebreed getting raided and giving up customer info a while back, rarebreed posted video saying what they though of crump...

A friend was contacted this week by the ATF about a FRT that she bought online. They wanted her to bring the trigger to them but I warned her not to do that. With everything happening today that crowd could arrest her and charge her with a felony for trying to do the right thing. She took my advice and took the trigger to our sheriff to hand to them and everything went smooth. The only glitch was I advised her to beat the trigger up so it could never again be used. So now some crooked gov agent can sell it to a thug and be used against honest taxpayers. I cannot understand how the ATF can get away with taking stuff from honest people that bought items with honest money.
