Does the ATF HAVE TO respond in a certain timeframe?

I figured if anyone knew it’d be ya’ll.
I had a form 4 ( trust) submitted on my behalf on Feb 18 of last year…. So we’re creeping up on 365.
Am I correct in assuming that since it’s the federalies I have no options except a better serenity prayer?

Edit to add: when queried at 300 days, they just said it was “ in process” and nothing we needed/ incorrect..

That’s the fun with this game…. Waiting. I’ve had some approved in 4 months. Others took a year+. As I’ve been told, it all depends on which box of applications they grab out of the hallway!

Members have had luck expediting their submissions by involving their Senators but you might be too late for that. Like RacerX said, it is a crapshoot. Some get approved quick, some get approved in bulk and some approvals get sprinkled around
 
I reached out to my congressman well before a year and had it approved in under two weeks. My buddy was over a year and reached out, had it back within a week and a half.

Have them bug the FBI first, as they are the ones usually holding up the process by slacking on the NICS check. Then when they come back to your rep saying it’s been approved, that’s when you have them bug the ATF.

I’ll be doing this at the 90 day mark for my next suppressor. Because why not.
 
A friend of mine cleared in 90 days mine was 11 months, another friend 13 months.
We e filed at the same business within three days of each other, so they don't seem to have a set in stone formula for approval
 
Just got approval on one-5 months to the day. First two were nearly 10 months (2018-2019).
 
there was some big flaw in their system around february, it's a known problem.
I know it messed up a whole bunch of Form1 applications, but i would not be surprised if it affected form4 as well

I contacted my rep over the summer and they got the atf to straighten it out FAST.
 
After waiting 14 months for approval on a hand written form the dealer he said it was lost in the mail or somewhere so he gave me my money back. I then called Silencer Shop & reordered the Omega 300 also a Dead Airmask from them. I did the kiosk at a local gun shop & they submitted them on 2/14/24. On 2/24/24 I got the approval for both of them. I couldn't believe it but I picked them up today. 10 days seems unreal!
 
I sent off two SBR filings over a year ago. when I called to make an inquiry they said that there are only five agents tasked with all the SBR stuff. It could be years before I see anything back at this rate.

Huh? I have 4-5 SBRs, I don't think I've waited longer than 90 days on any of them.

They stopped doing the free Form 1 when the ruling come down.
Several I know found out they were only a few days out getting it. Now they must remain a pistol or pay 200. Even being they beat the deadline.

I think this is incorrect, ATF said that is was acceptable to use the confirmation of the form 1 as proof of compliance until it was either approved or denied. This only applied for the ‘free’ form 1 under the now blocked rule. Anyway, if your friends filed they should be golden, just gotta wait.

Can't use a stock.

The guys at the local GS say they are hearing the same.

I'm glad mine all got approved.

I believe that is correct.

I don’t know what happens if the rule gets overturned. They were approved with a limitation saying something like “in accordance with rule xyz” so I think they may become unapproved if/when the rule is overturned. I’m in the same boat on 2 and have given away my pistol buffer tubes.

they've kind of painted themselves into a corner, haven't they?
first say they are legal let millions get them, then say they are illegal, then say they are only legal with approved application, then botch the application process. if the courts strike the ruling down, we will be stuck with more people who did the exact same thing, and only some are legal, but are only legal based on an illegal finding.

repeal the NFA

I think that ATF will stop trying if the rule gets overturned, simply say that they are all unregistered SBRs and suggest that folks file before agents show up at your door. Much depends upon SCOTUS’ ruling on Chevron.
 
I've never waited less than a year. Paper, E-form, doesn't seem to matter....

I can't see that holding up. the best they could probably get away with is a massive "my bad" and instruct everybody to destroy the braces again
