Judge rules in favor of plaintiffs suing Baker over covid pistol permit shutdown

I'm not sure I get it. We need more plaintiffs to sue since this plaintiff now has her permit?

Whether the plaintiff has her permit now is irrelevant. The CLEO of her County infringed upon her right (forget that these Jim Crow permit laws still exist) to own and carry a firearm. If she had been murdered and the circumstances proved out that she might have survived *if* she had had her handgun, I would hope this CLEO would've been sued for wrongful death.

Yeah, I don't think anyone could argue in good faith that the case is moot. It would have to be impossible for Sheriff Baker to suspend the issuance of PPPs, regardless of the plaintiff's permit, for the basis of the complaint to be moot. Think about abortion cases... they still get to SCOTUS, even though the baby is going to be born long before litigation works its way through the court system.

If it were me and The Second Amendment Foundation, Grass Roots North Carolina and Firearms Policy Coalition we’re backing and pretty much financing the suit I’d keep on pushing and my cut would be $1 and they could split the rest of whatever my “damages”the court deemed if we won.

He has a limited insurance policy covering lawsuits. I would say under $100,000 per occurance. The county attorney will represent him but they will need help. He’s got a problem depending on the jury selected.

He’s still dragging his feet on Purchase permits and concealed carry. Me and a bud took the concealed class in January and the first available appt at the sheriffs office was 6/29. [emoji2959]

He is even breaking NC Statutes by not making CHP renewal appointments until the holder is 45 days from expiration instead of the Statutes 90 day window ... he’s keeping renewals from applying 45 days earlier.

I seriously doubt His department will process a CHP renewal in 45 days either ... considering the packet has to go to the NC State Bureau of Investigation for state approval and the CHP card to be printed and then back to His office. All that to & from shipping and receiving plus interoffice handling and foot dragging ...

To renew your CHP you do not have to have the new permit. As long as the paperwork is filed and being processed you are GTG for CC per my Sheriff's office. Not condoning his behavior. Just putting it out there how renewals are handled when the new permit is not received by the time the old one expires. The system shows it as being processed, not expired.

Yep, just can’t be used for purchases because it exceeds fhe 5-year threshold...but perfectly ok to carry concealed.

§ 14-415.16. Renewal of permit.

(c) Upon receipt of the completed renewal application and the appropriate payment of fees, the sheriff shall determine if the permittee remains qualified to hold a permit in accordance with the provisions of G.S. 14-415.12. The permittee's criminal history shall be updated, including with another inquiry of the National Instant Criminal Background Check System (NICS), and the sheriff may waive the requirement of taking another firearms safety and training course. If the permittee applies for a renewal of the permit within the 90-day period prior to its expiration date and if the permittee remains qualified to have a permit under G.S. 14-415.12, the sheriff shall renew the permit. The permit of a permittee who complies with this section shall remain valid beyond the expiration date of the permit until the permittee either receives a renewal permit or is denied a renewal permit by the sheriff.
 
So this guy chose a career in law enforcement but doesn't comprehend that when the law states "shall," it is not optional, and when the law states "shall not," doing so is the definition of breaking the law?

He has been sued several times already for PPP/CHP violations, and he doesn't change. Maybe now that anyone who was denied a PPP can sue him, the county attorneys might remind him that he has to obey the law like anyone else or else it's going to get really expensive for the county. And that doesn't count all the legal action about broken contracts, retaliatory firing of deputies who reported their supervisors making homophobic jokes, maybe more, I can't keep up.

And what national organization is conspicuously missing from this list of people that won this victory? "The Second Amendment Foundation, Grass Roots North Carolina and Firearms Policy Coalition filed suit with Stafford."

Donnie's running to get his job back in 2022. Can't come soon enough.

Took mine in October and have an appointment first week of May. My friends (live in Forsyth) took it with me and have had their CHPs for weeks now. I understand "demand" is high, but it should not be this long of a wait.

Yes. You can use an NC CHP in place of our dumb PPP, or in place of a NICS check for a long gun/other firearm.

But the Brady exemption is for 5 years from the date of purchase. That’s one reason a lot of states issue 5 year concealed permits. Once your CHP expires, you can continue to carry if you submitted your renewal before the expiration. But you cannot use it to purchase because it’s past 5 years.

Not sure how it works with a renewal in SC, but you couldn’t use it past the 5 year mark either. Here’s a list of states that have permits that can be used instead of a NICS check:

I am just saying he is making his own rules by saying he won’t give you an appointment unless your CHP expires within 45 days not the 90 days stated in the NC General Statutes governing the renewal of CHP’s ... another case of him thumbing his nose at the statutes at the expense of those he think of as his lowly peasant subjects.

We are not a nation of laws as much as we are a nation of political will. Wake County residents don't have the political will to force him to obey the law.

I'm not sure what plaintiffs would sue for, unless they had some sort of monetary loss or were shown to be at risk of harm and harm was done or they had to invoke other means of protection. I wonder if gun store owners can sue for loss of sales and financial hardship.

Badges don't change the law, just exempt the wearer.

Pretending the law means whatever you want it to mean? Well that's what black robes are for.

You have to recognize the separation of powers. Things only work smoothly when everyone knows their place and stays in their own lane.
