Open carry of the rifle by someone under 18 is only a class a misdemeanor in Wisconsin. Even if he is found guilty of that, he does not lose the right to claim self defense under the doctrine of necessity. The only thing he could lose, and I am not sure about Wisconsin law, is stand your ground. Since the guy had a molotov cocktail, there was no safe avenue of retreat. Before the conflict with the other rioters, he was retreating until he fell down and at that time could not safely retreat.

so we should all put our heads in the sand, and let the children throw their temper tantrum’s in the big cities until they’re all burning? Small business owners should bear the financial burden of these ass hats looting and destroying private property?

I’ve done a few turns, I went to VA in January, and several recent counters here in in NC.
And when this starts happening here I’ll be out with my brothers again.

not to mention they are foolish enough to charge him w/ 1st degree...can they charge him differently after the fact? As of now he doesn't even need to prove self defense, he just needs to prove he didn't commit premeditated murder lol.

If the multitude of videos wasn't enough evidence he had not acted in premeditated fashion, the 'pre-shooting' video by SnowRooster is the slam dunk. Thats one incompetent DA that charged him with 1*.

But honestly, these guys were all white so nobody gonna care. or maybe they were black just doing white face for the day? dunno. but its all white its alright.
 
This Is what the full vids show. Perfect example of good reporting on your part. I noticed they left out the part about being attacked and the attempted fire bombing of him. This boy is in Trouble. Life Over. If ever there was a case of a misguided, well meaning , sadly used fella, this is it. Or so it seems right now.

It shouldn't be, but he's the low hanging fruit here and he doesn't have a Soros sponsored get out of jail free card.

That is my understanding of the events as well. One addition, unconfirmed, I have read that he was part of a libertarian group that was there to both support peaceful protesting and protect businesses.

As to the assertions that he shouldn't have been there? None of those asshats should have been there.

As to the assertions that he shouldn't have had a gun with him? Well that is absolutely asinine. If he hadn't had a gun with him he would be either dead or in intensive care right now, courtesy of the friendly protesters.

He tried to flee the attack, they tried to lite him on fire. He defended himself and continued to try and disengage from the attack. He was attacked again by multiple assailants and he defended himself again. Then he continued to disengage and flee while under fire.

If this isn't a text book case of the use of deadly force in self defense I don't know what is.

His age and whether or not people sitting behind keyboards feel he should have been there have no bearing on the sequence of events.
Exactly, whatever the age a person has the right to protect themselves from deadly force. The shooters age may get him charges for braking state laws as a minor but in no way can the state get a conviction for murder by this child’s action. This may be the case that shows adult gun owners their rights and more so responsibility to resist life threatening events.

I wouldn't lay down and let them destroy my property and livelihood. And I don't think this kid was protecting his property and livelihood? If the people whose property was being destroyed in another state and they are doing nothing about it themselves, I'm sure not going there to do it for them. It sounds to me like Jr should have joined the military instead of going all mercenary on his own.
 
From what I can read on the Wisconsin hunting regulations site, persons ages 14 - 17 who have completed Hunters' Education can possess legal shotguns and rifles without being accompanied by adults. That might work in his favor if he has completed a course and if Wisconsin recognizes a course from another state.

He wasn’t hunting that regulation applies only while hunting. Claiming he was hunting will not help his case. o_O

They are adding that in order to attempt to show he knew he had broken the law. It does not work in his favor that he did not turn himself in. Even if the shooting was justified you don't just drive home and get into your PJs and go to sleep after shooting 3 people on a public street.

So you would encourage your 17 year old kid to go get involved in riots like this? "Hey son, BLM is going crazy over in Kenosha. Grab your gun and go show them we ain't gonna take it."

As has been pointed out elsewhere, he was less than 20 miles from his home.

What's the relevance of whose property and livelihood is being protected? You wanna be on your own when the time comes to defend life and livelihood? If not, why would anyone else?

I don't care that it wasn't his property or livelihood, the whole point is that he was willing to do it on someone else's behalf. That's the kind of person we ought to stick up for....

I am very optimistic that the phone call he tries to make immediately after popping that one roided out, muscle-bound communist in the dome is the police. I'm obviously speculating, but that will be easily verifiable to police in very short time. that act of dialing [I presume 911] is only interrupted by the subsequent continued provocation by the degenerate mob....

after cooling down a bit and analyzing more, it is INCREDIBLE how damn proficient and discerning that kid was with his weapon. Think about how MANY non-attacking bystanders and non-immediately-life-threatening attackers there were in this ordeal. He managed to dispatch exactly those who posed IMMEDIATE threat to his life, while incurring ZERO collateral injuries. Not only the marksmanship and tactics while shooting from ground etc, but his clear focus and concentrated effort to employ the minimum amount of lethal force as necessary...that kid is a bad poop hole cushion mamma jamma (this is NOT the Tortuga thread correct?)

This kid has shown more balls than 90% of the “patriots” bitching, pissing and moaning about the state of things our country is dealing with.

He properly armed himself for the possible threat and used his tools just enough to survive the encounter, if more people would actually get involved rather than letting someone else handle it, the majority of this BS would have been quelled by now, but at the end of the day, the path of least resistance and all that.....


The videos clearly show he was defending himself, ok he was a minor with a long gun, give him his ticket, give him the key to the city and send him on his way.

I have been carrying extra loaded mags in my truck when I'm out, but I might just start carrying a rifle in the truck. I'm trying to stay out of the downtown cities, but I want to be prepaired.
 
Open carry is legal for any person that is 18 years or older and not prohibited from possessing a firearm under state and federal laws. Concealed carry is legal for residents with a Wisconsin Concealed Weapons License (CWL) and for non-residents with a license/permit from a state that Wisconsin honors.Jun 30, 2020

He was not prohibited from possessing the rifle under state law if he had completed Hunter Education.

there have been other cases, multiple federal cases (didn't get a chance to fully vet that link's decisions), that say even a felon is entitled to self-defense using a firearm... but the may still have to face the felon-in-possession law.
I don't see how this could possibly be any different, except that he only committed a misdemeanor instead of a felony.

I'm classified in the 'too much of a female reproductive organ to legally sink my entire life' bucket. Naturally I wake up every day hoping to light up my computer screen and find out the war has begun so I can "serve" my country, legally.

From defensive standpoint, I'm with you (and the many others) on upgrading my defensive tools.
