Is it ok to lend carry guns? Or in general to lend guns. Lets say someone needed a carry gun because his was out for repair. Thoughts and legalities on that???

I don’t see how it could be an issue as long as they’re legal to own one. I loan friends pistols all the time when they fly out to see me and don’t feel like bringing one with them. It’s literally like the scene from 13 Hours when ‘Rone hands Jack a pistol after landing at the airport whenever one of my friends comes into town

Can you explain where you think the problem might be, I really can’t think of one unless it’s that you only have one gun and you just loaned it out.

Being semi new to NC, and freedom in general (being from ny), I honestly was just not sure of any legalities. I guess my major concern being if it was used to defend himself etc.

Had a long and pointless thread about a similar issue a while back. The gun is just a thing, if your friend uses the gun in self defense then he used a gun in self defense, where he got it isn’t important. If he uses it to rob a liquor store, that might be a different issue depending upon what you knew about his plans, but otherwise also not an issue. If you know that he is a felon, is a convicted abuser, or is otherwise prohibited from legally possessing a firearm, then you have a problem.

I’m not a lawyer.

In Colorado that is considered a “transfer”. You can not transfer without using an FFL. We got this law along with our magazine capacity restriction.

I never lend a gun. If a person needs one they should buy it themselves. Saves a lot of potential headaches.

This is my position, as well. I never lend them to anyone for any reason. Letting someone shoot them with me present is a different situation, but I never lend them out.

I have a friend who I have lent a gun to and I have had one lent to me when I had mine stolen.

I currently have a couple of my parents guns in my safe. They live in OH. I am holding them in safe keeping as they are planning to move to NC and I have a safe and they don't. They are not mine. I do not own them. I may carry one of them sometimes as I like it and I have permission to do so from the owner. They have also said they would like to give them to me as they have since obtained ones they like a lot better.

I am waiting for them to move here officially. Then after they are officially residents they can privately transfer them to me, no FFL required.

From "North Carolina Firearms Laws," Section II. D. This is what Roy Cooper et al thought the laws were.

If the firearm is loaned or rented for use on the licensee's premises, the transaction is not subject to the Brady Law. However, if the firearm is loaned or rented for use off the premises, the licensee must comply with the Brady Law. 27 C.F.R. 478.97.

That law was aimed at eliminating our ability to sell / buy direct. The wording of the law states what the government deems a transfer. Loaning a Gun even though it is a loan between friends to the government (with this Colorado law) is considered a transfer. Bottom line poorly written law.

I have borrowed some guns for use at the range; some because they were just fun as hell to shoot, some to see if I wanted to flip the coin to buy (try before you buy and all). But never outside of range use.

I've never loaned one to anybody that didn't have a CHP, so even if it was considered a transfer there wouldn't be an issue.
