Long Guns in Vehicles

Guys,

Way, way over thinking this topic here. Its simple as hell.

Only access to a firearm for self defense use is a open carry gun or a concealed handgun with permit. Does not matter if in the vehicle or not, why? Because the state law says this about your vehicle.

The state is telling you, that a person can not tell the difference between an attack on a vehicle or upon their person while occupying the vehicle. Its one in the same.

Outside of self defense, why do you need quick access to a long gun? You do not need it to go hunting, to the range or transportation from point A or point B. So the status of the longgun should not be ready for a defense use.

Its simple, if the gun is for self defense the only concealed gun is a handgun with a permit. Open carry is for longguns and handguns.

Where in your link does it say this?

Say what? I made like four points. LOL

Sorry! I thought it was self-evident because you posted a link right under your statement:

"Only access to a firearm for self defense use is a open carry gun or a concealed handgun with permit. Does not matter if in the vehicle or not, why? Because the state law says this about your vehicle."

Where does it say this in the link you provided?

That is not stated because the law I quoted is the Stand your Ground Law for North Carolina. That link only shows the state does three things in a self defense situation.
1. The state assumes you have a legal right be at X location. X location being a home, a vehicle, a tent, office, etc
2. The attacker has to prove they had a right to be at that location.
3. You will not be tried civilly if proven innocent in criminal law.

I posted the link to show the correlation between a vehicle and ones person is one in the same if you are in the vehicle.

Moving on to the the over arching topic
NC Concealed Carry laws states the following:
1. Carry a concealed handgun. - The term includes possession of a concealed handgun.
2. Handgun. - A firearm that has a short stock and is designed to be held and fired by the use of a single hand.
3. 14-415.11. Permit to carry concealed handgun; scope of permit. (a) Any person who has a concealed handgun permit may carry a concealed handgun unless otherwise specifically prohibited by law.

We now know the ONLY way to have a self defense firearm that is CONCEALED is two things.
1. It's a handgun - not anything else
2. You have to have a state issued permit.

Download the attached pdf, go to page 24.

Now we have the framework of this

The below link is the state law on what you CAN NOT DO. That means what is not spelled out you can do.

Enjoy.

From first section: “It shall be unlawful for any person willfully and intentionally to carry concealed about his or her person any pistol or gun except in the following circumstances:”

A couple things. Legal words have specific meanings, “about” generally means near. I believe this is the accessible clause, but that would be a good question for an attorney, when is the gun no longer “about” your person.

Next “any pistol or gun” is all guns. Long, short, big, small. So, NO guns can be concealed and accessible, unless… All the other references allow exceptions to the NO Guns. Those exceptions only apply to handguns as mentioned. Long guns not listed just means there aren’t exclusions for them. Not that they’re permitted. IMO anyway…

Edit: I’ll add I think most politicians are more ignorant than nefarious, and they write the laws. But then ignorance is not an excuse…

I occasionally drive my Cj8 style Tj to my monthly cas match. In order to fit my rifle/sg in the cab I built a shelf over my windshield. I velcro strap them up there and stow the handguns, belts etc and ammo in my trunkbox under the aluminum tonneau cover. I have a NC ccw permit. I’ve never gotten stopped in my Tj. I don’t think I’m in violation. This was before I had the tonneau built. 79280D20-E858-48F1-8033-ECF1EA356F78.jpeg
