Does Tire Rotation Include Tightening Lug Nuts? Michigan Court Thinks About It For Awhile, Concludes 'No'

In what will surely go down in history as one of the most Galaxy Brain court rulings of all time, a Michigan appeals court determined that a tire rotation does not, in fact, include tightening the lug nuts.

It is a ruling that not only defies common sense but has potentially broad ramifications for Michigan car owners who may find it much harder to sue mechanics for doing unspeakably dumb things, such as not making sure the damn tires stay on the car.

This is an appeals court ruling. Judges must have the least amount of common sense as any profession out there. There really needs to be a way to hold inept judges accountable for their rulings that defy logic. We see it all the time in certain gun related cases but a ruling as dumb as this one has no political or any other bias driving them. It's just stupidity.
 
And how many here trust a business to torque lug nuts down correctly? First thing I do on the rare occasion service requires a tire(s) to be removed is pull into the parking lot and pull out my breaker bar (I carry one in place of the tiny useless lug wrench most vehicles come with) and verify all lugs are at least tightened. When I get home I break all the lugs loose, occasionally I’ve had to use extra leverage because some idiot set their gun to gorilla tight ft-lbs, and torque them to spec. I NEVER trust places ... especially when it comes to things that can quickly wreck your ass!

I was going to try to help a "friend" change his brake pads. They had ran his lugs so tight it would've been hard for Superman to get off. I guess it's a good thing we couldn't get them off, cause if I would've screwed something up and he would have died. Then once they found out he had been screwing my wife I would have been the suspect.

Ridiculous ruling, but I hope that wasn't a legitimate news story from a legitimate media source. An actual journalist that starts by biasing the story in the first sentence shouldn't get to post another... ever.

Well they can't figure out what "Keep and bear" means. Why is this surprising???

We need a process that allows the public to get judges tossed for incompetence.
Right now they either have to be judged by their peers... drinking buddies, golf buddies, poker friends (other judges) or they have to be voted out in the next election where most voters don't pay attention to the judges they vote for. We need the ability to have a petition signed and have judges reviewed by a civilian board, for competence.
 
As I read (quickly, I admit) the act, I would agree with the court that the mechanic's failure to *competently* do the tire rotation is not a violation of this act. But that does not relieve the mechanic/shop from liability for its negligence. If a shop was paid to paint a customer's car and did so using interior latex paint, it would not have violated this act, but it would certainly be liable under some other law. I think the plaintiff's attorney just picked the wrong law to hang his argument on.
 
The dodge place in Garner failed to tighten the lug nuts on my work truck one time. Started squeaking on the way back to our shop. When I pulled the cover off two of the nuts came off with it and three others weren’t even hand tight. Luckily it’s an 8 lug truck and no damage was done in the two miles it was driven.
 
........WTF.......you could EASILY get people killed by not tightening down the lugnuts. There is nothing funny or forgivable from that if something bad happens. I used a local frame shop a while back......to do it right I had them align the frame after a minor fender bender before i bought new tires. The next day after after driving 75 mph or so......the tire shop told me only 2 lugnuts on the front were tightened...... The others had vibrated off during my commute. From someone who has been in a major car accident
