What he did was stupid. Would I convict on this charge and put him in prison, no. Here's why: the two tiered, corrupt, legal system has thrown the book at too many normal people for small offenses while simultaneously turn a blind eye to all sort of violent, destructive, and dangerous actions when the perp is of their preferred political persuasion.

Consequently, I withdraw my willingness to be a part of the system or do the bidding of the state.

Seeing the outcome of the incident, I could go along with some sort of restitution to the deliver driver, but not what the state is pursuing.

And that is why you should not be on a jury pool. Just state the above when they call your name and you will be excused.

Guy shot seven times at a pizza delivery boy because he thought that he was breaking into his truck


The article said the homeowner was shooting at the truck and the pizza delivery boy was not in the truck. Therefore, I could not vote to convict on any charge involving a personal assault. However, I could vote to convict on a charge of property damage to the truck.

I would vote to remand the shooter to mandatory firearms training; 3 hits out of 7 shots at a stationary target as large as a truck is abysmal.

There's a lot of things I'm fine with lethal force for the law may not be. A vehicle in the drive isn't one. It's possible he didn't shoot at the delivery person, seven shots and three hits raises the question of what was being shot at? I'd be fine with every discharging a firearm, property damage, brandishing, terror of the public, etc. charge.
If the details are as plain as presented if the delivery person has returned fire I'd be inclined to see it justified.
 
Some of yā€™all are scarier than the broken system. The bluster and grandstanding is strong. Personally, I think thereā€™s noway some of yā€™all would follow through on your soapbox rants.
 
So I don't know if protecting property with lethal force is legal in that State, I doubt it. So the shooter is a complete idiot for opening fire in a case where he "thinks" something is happening to his truck.

Even if it were legal to protect your property with lethal force...there was no need to 'protect' his stuff - kid was just delivering some pizzas and pulled into the adjacent driveway.
Simple mistake, these houses are tightly packed in, little room between them. A pizza delivery takes all of 2 minutes (if customer sees them pulling up), no harm no foul
No need to shoot at anyone.
I dont care if he was aiming at the truck and the kid was not in it - throw the book at him.

I dont care that he's a proud patriot gun toting citizen blah blah blah, he's a fool and the reason there is a constant stream of proposed legislation, he fuels them.

Oh I agree, he would have been charged in any case because even in a State where you can protect property with force he would have been factually wrong because nobody was stealing anything.

I was under the impression Texas does allow that, somebody know for sure?

In a typical "defense of my chicken spit arse" scenario, the shooter tends to fire until slide lock. Did he stop partway thru or was he shooting some oddball model?

If he stopped partway thru the mag, indicating he finally realize what the situation was....there goes the last of his "in fear of my truck" shooting justification.
 
The courts are supposed to look at what the person was seeing/thinking at the time of the incident, what a reasonable person would think was happening, and without hindsight. If he can somehow convincingly articulate why he thought someone was trying to steal his truck, and why it would be OK to shoot and possibly kill a person he thought was trying to steal his truck......maybe he skates, but I doubt it.

Glock 43? Mag capacity is 6, +1 in the chamber.
