Out of State Purchase

Can I legally go from my state (NC) into SC and purchase a handgun? Or, can someone from SC meet me in my home state in NC and sell me a handgun? I have a NC CCL, never convicted of a felon and basically as squeaky clean as it gets.
 
To be within The Law, for buying the handgun your seller will need to get it into the hands of an FFL within the state of NC. Some will accept delivery from a person, some won't. You'll have to fill out a 4473 to receive the gun from the dealer. The dealer will collect a fee but will not handle your money, only the gun. You cannot do this transaction outside NC.

If you're buying a long gun you could do this same transaction at any FFL, theoretically in any free State.
 
…and just to clarify/add to the convo.

You can’t even buy a pistol at a dealer outside of your state, and take it home. You’d have to buy it from them and have it shipped to an FFL in your state.

Summarizes this way:
1. All firearm transactions that cross state lines must involve an FFL
2. If it’s a long gun, that FFL can be in any state
3. If it’s not a long gun (so handgun or other firearm, which includes receivers/lowers/etc), it has to be in the buyer’s state
 
Thank folks. I was not aware the US Government had done so much to alter the 2nd Amendment! Again, thanks and I will be certain to avoid stepping outside the legal ways left to purchase a hand gun.
 
For someone selling near the border like VA, SC, or TN, can they bring their out of state gun to an NC FFL in-person to have the transfer done to an NC resident?

Yes it's legal but it's up to the FFL in question. Ask before you set up a deal like that.

Not so on long guns.

You can drive to GA and buy a rifle or shotgun from any store or bubba and take it home.

Hand guns either have to be carried to ffl in different state by owner or shipped to ffl in different state by owner.

That bit is incorrect if I read you right. If Bubba is from GA you have to use an FFL to buy his shotgun. legally.

Wrong. Anything that’s not a long gun requires it. So stripped AR receivers, complete AR receivers, firearms like Shockwaves/etc, anything else that’s not a long gun…all require in-state FFL.

Wrong. If, as @Catfish pointed out, Bubba doesn’t have an FFL…you’d need an FFL involved for a legal transfer.

At least you didn’t strike out…batting .333 could get you a nice paycheck. Although, it would get you fired in most businesses.
 
What if two North Carolinians happen to meet up in a different state to do a private sale? I assume that'd require an FFL, but just curious.

No ffl required as I read it.
 
Have to admit I was wrong.

ATF says “firearm” from different state of residence requires ffl as stated BigWaylen’s post. Long guns can just go through the other states ffl the way I read it.

Been a LONG time since I looked at those rules. Could have sworn it WAS ok for long guns (rifles and shotguns) between individuals not to need an ffl between states.

Did it change in last 30 years? Hopefully someone can chime in on that. Always willing to learn.

Handguns have required a ffl transfer in your state of residence if coming from out of state as long as I remember.

Gun Control Act of 1968 required FFL for interstate transfers
