I recently won a 10.5in Aero precision Ar15 pistol in a raffle. Pretty sick prize. But if the ATF has it's way, it's gonna get classified as an SBR soon and I dunn if I wanna deal with all that.

So my question is this: if I were to trade it in for a 9mm pcc with a folding brace, am I just gonna run into the same issue with a pcc?

Anything with a shorter than 16 in barrel and something that looks like a stock will be an SBR and require stamps and all that, right?
 
Brace and <16” barrel will be just like a stock and <16” barrel if the ATF gets its way. PCC isn’t a term that matters to ATF.

Congrats on winning the Aero pistol, that’s awesome!

To answer your question, AFT doesn’t care about the caliber (yet). Less than 16” barrel with a stock or brace would be SBR if they get their way.

If you want to avoid that possible issue, trade the upper for a 16” upper.
 
You could also remove the brace until all the legal dust settles and decide what to do later. As far as anyone knows right now, a bare buffer tube is legally ok with a short barrel.

That seems to be the subject of some debate. At least one ATF letter says the type of tube doesn't matter, but some people warn about constructive possession, and still other people say as long as there's any possible legal configuration for the parts you own, it's fine.

My conclusion is that if your involvement with ATF has reached the point of buffer tubes being scrutinized, they're gonna find whatever they need to charge you with whatever they want. After all, this discussion is only happening in the first place because they reversed course on a decade old precedent at a whim. Who knows, maybe any buffer tube is evil because you can stick a tennis ball on the end of it.

Maybe. I wouldn’t put it past them to say that a carbine tube with a short upper showed intent. I will have an AR upper with a pistol tube simply because it is concealable with a permit (in NC at least where size of pistol doesn’t matter) - mostly to have it cased within reach in a vehicle. Otherwise the $200 for stamp makes more sense to me.
 
Take off the brace and you have a pistol to satisfy the ATF goons. Then decide what to do down the road or once they determine the ATF is wrong and allow braces again.
