Pistol brace questions

So with the current nationwide injunction in place, is it legal to sell braced pistols (used/private or new/retail)? Are any retailers doing so? I see a few outfits selling the brace itself (with lots of disclaimers as to what you do with it). Is it legal to create a new braced pistol (attach a brace to a pistol)?

Maybe "legal" isn't the right term in this strange situation. How about "not legal but not to be prosecuted/enforced at this time" (lol)?

Yes, and it was never illegal to sell or buy braces in the first place. The biggest issue right now is a) finding them in stock, and b) paying stupid markups since they're back in high demand.

And yes, major retailers are back to selling braced pistols, including Palmetto State.

Thanks, I can see that braces are being sold. The question is can braced pistols be sold and/or manufactured?

I'm fairly certain I saw some at Blackstone Shooting Sports in Charlotte a week or so ago. Not SBRs but actual pistols with braces installed.
 
Shops I talked to do not want to mess with them.
The risk is too great.
Things can change fast and then they are stuck with the problem all over again.
 
Thanks. Just to be clear, as far as anyone knows openly purchasing an AR pistol and a brace retail and combining them would not be cause for concern? Asking for a friend. :rolleyes:

I got a job at a gun shop recently. Where I work we currently have braced pistols on the shelf and they are sold regularly.

You can buy one right now in person with the brace attached.

For how long? I don't know. But as far as I can tell your good to go at this moment in time.

I’m not really sure how your question could have been answered any more clearly…proceed…you are good to go…. Buy them…make them…whatever, it’s all good.

I'm happy to help. Buying a braced pistol is not manufacturing one. Selling a braced pistol is not manufacturing one. The question as to the legality of manufacturing a braced pistol during this injunction has not been answered yet.

Geez Alan. Stop overthinking it. There's legally no such thing as a "braced pistol". There never was. Not a category. Not a designation. Kick the ATF out of your head. It's an accessory. First it was an accessory that was "not illegal" to add to your pistol. Then the ATF tried to make it illegal. Now with the injunction it's once again not "an illegal" accessory.

If I put an optic on a handgun I didn't "manufacture" an "optically enhanced handgun". I put an accessory on. Period. The ATF has no designation for that, there is nothing to apply for, there is no "manufacturing" of a category that does not exist.

Technically you're correct, but both of those responses were a single yes to a two part question, and if there is anything this and other forums have taught me is to not assume.

Ask yourself this; could you make braced pistols prior to the ATF attempting to get their little “rule” in place?

The federal judge stayed the “rule” in its entirety..that’s pretty clear to me.

I can assure you Bill that if the ATF ever freaks out about putting optics on your pistol like they did braces I'll be asking the same questions. Can't have the hoi polloi running around with assassin sniper pistols can we?

I disagree. More hoi polloi should be sniping "stuff" if you ask me. Now more than ever.

Hahahaa I've been saying that it's only a matter of time before red dots/scopes get backlash for assisting the shooter to shoot too effectively
 
I find it interesting that PSA feels confident enough to sell them again at this point, I don't think the legal battle is over just yet.
 
Good time to get what you want.

If they go illegal again, trade braces with a buddy that doesn’t have anything that fits yours (and vice versa) until it is legal again or you SBR it. If you care about legal.

You have the proper FFL to manufacture one?

If not, you’re making it…not manufacturing it. 😝
