A California man had his registered firearm seized by local police after “antifa” members on social media accused him of being racist on the internet — the first case of its kind.

On July 7th/8th, left-wing extremist twitter user @anonymouscommie doxed a Sacramento resident named Andrew Casarez. The anonymous account accused him of being a “neo-Nazi troll.”

On the very same day, the Sacramento County Sheriff’s Office opened up an investigation into him. During a background check, they found that Casarez was a registered gun owner. On July 13th, 2020, Sergeant Nate Grgich executed a search warrant for his home and car.

Nothing illegal or of a criminal nature was found during the search, but Sgt. Grgich was able to get a judge’s permission to seize Casarez’s handgun, a pair of pants and a “racist” t-shirt using a new law enforcement tool called a “gun restraining order,” which was signed by Judge Jaime R. Roman.

The Sacramento County Sheriff’s Office is bragging about being the first in the country to seize a firearm using primarily the owner’s political ideology as the excuse.

Sheriff so proud to be 'THE FIRST' to violate the rights of a citizen who has not committed any criminal acts. Red Flag law is bad idea.
Is the the new 'Reimagine the Police' by having preemptive enforcement with no crime(s)?

The sgt should be fired, and the judge removed from office. Who cares if he's the biggest racist on the face of the earth, being so is not against the law. Unless there is a credible threat made by him red flag laws should not apply in this case. But, we all knew they'd be abused for bullshit like this.

That may very well be true, but there is a significant difference between someone committing no crimes but being punished because of an anonymous tip and someone who is trying to burn a federal building being hauled in by federal LEO trying to protect the federal property.

I am not a big fan at all of red flag laws since they can easily be abused as seems to be the case in this situation.

On the case, spokesperson Lacey Nelson was quoted as saying “This search warrant it’s the first of its kind at least in the country. As far as how we obtained it and were able to serve it […] He was posting enough racist rhetoric and propaganda on Facebook that it was concerning that his behaviors could become violent in retaliation.”


Nelson also said “Instead of waiting for him to go out and commit acts of violence, per se, they were able to ideally stop it before it started. But he did have a firearm in his possession.”

Guaranteed this is trying to push the overton window left.
This guy will likely win a huge payout because they confiscated his racist gear and his gun - clear violations of amendments 1, 2, and once those are found to be violated, the warrant was illegal and violated 4A.
However - what does the state really have to lose?
They already can't do this and they know it.
So they do it - but you can't sue them directly because they "believed" what they were doing was legal because a judge signed off on it. Judge is exempt from prosecution for it. Police are exempt from prosecution for it.
The guy may bet a boatload of money - taxpayer money.
Nobody in the government is being held responsible.
Next time though, they may accidentally win the case on a technicality - then it's considered legal.
Then they can keep doing it to people and expand its uses - hey, they believe they're doing the right thing because it's based on a legal precedent and a judge signed off on it...

Last guy who did anything about this was Dorner, and he died when he was another victim of "accidental" burning/exploding due to a pile of smoke/gas grenades followed by flashbangs to light it all up... "accidentally". He's a lot more of a hero than people give him credit for.

Maybe history has altered my memory... but I believe he took issues with the LAPD being corrupt and abusing people, and they fired him after he made some complaints.
So he killed a few LAPD cops and a couple of their family members (which is the distasteful part of what he did).
LAPD has a long history of abusing people and being corrupt, so I don't know that i see him as much of a villain.
And then while looking for him and his truck the LAPD basically justified everything he had been doing by firing a buttload of shots at 2 women delivering papers in a different make/color truck - and they were found justified...

He was disgruntled because of an unjust firing he said. May or not have been and vowed to get back at the LAPD. Manifesto and all.

He ambushed and killed an officer, a U.S. Marine two time combat veteran and father, another officer that had two kids, another officer and girlfriend during his rampage. Clearly, you and I have a different meaning of a hero.

You are correct during the manhunt for him did result in some awful policing.
Innocent people were shot and maybe some cars being rammed etc. Those were never properly handled with any type of firings or accountability which wasn't right either.

The leftists are so proud. They honestly believe actions like this will be welcomed by the average American. They cannot conceive that this is viewed as an atrocity.

Well, when you realize that was the entire purpose of the so called "red flag laws" to start with, they are not being abused. They are being used exactly as intended.

Without registration of firearms, this likely ends with "Oh, he typed some words on the internet" without anyone ever leaving the office to go visit him.
Once he popped as a registered firearm owner, all bets were off.

The red flag laws are simply the steps that followed registration and they complement each other so well

socialism / communism is something you can vote your way into, but not out of.

There are reasons I have routinely stated in the past that they can take their warrants and shove them where the sun don’t shine. It won’t be recognized on my property. Strip away the illusion of “authority” and those cops are no different than common street thugs and bullies.

I agree. They will use this and go after who they decide needs to be punished. Hope the guy sues and wins and they stop this kind of thing. Like doxxing on another level.

Dorner killed the daughter of an ex LAPD captain that he had beef with.
Even a self proclaimed vigilante should have some morals, no women or children. None of the officers he killed were LAPD.
