Wow. I don't know what to say to this other than wow. So much fail. This cop needs to be gone if he is drawing a gun over a pack of mints against a man who has offered no resistance. It could have been as simple as, "hey did you pay for that?"
 
Indeed, I suspect it would be assault with a deadly weapon. Instead he's getting a departmental review for policy violations. He should be facing the criminal issues first because they're more serious. Get convicted and his job policy becomes moot.

Civil lawsuit against him that will be settled. Bet he did not show a badge or id.
 
Wonder what would have happened if the guy turned around and saw gun pointed at him, thought he was being robbed, drew his own weapon and shot the off duty cop? I had to listen several times to hear him say "I'm a police officer" and don't know that I would have heard if I hadn't been listening for it.
 
A: Cop is a moron, it's a pack of Mentos, It would take alot more than that for me to get involved on my day off.
B: Did anyone else catch the fumbling draw and the gun coming out with the holster still attached? ReminedR me of the Police Academy movie with the guy waving the gun around with the holster still attached.

Wonder what would have happened if the guy turned around and saw gun pointed at him, thought he was being robbed, drew his own weapon and shot the off duty cop? I had to listen several times to hear him say "I'm a police officer" and don't know that I would have heard if I hadn't been listening for it.

I was thinking what if another CCW or cop walked in and saw (what appeared to be) a dude with black hoodie holding up the store and customer and drew his own weapon?
Could have been bad for everybody.

That was an impressive 5 second draw from concealment tho. Heh.

I will give the Chief credit for not throwing his officer under the bus. However I imagine when the Mayor calls and says we have to cut a check to this guy....that officer will go away.
 
He never left the store, this is not theft.
There are a couple of states where concealing an item is, Maine I think.

He's lucky it wasn't Caren Z. Turner he pulled the gun on. He'd have gotten a nice, piping hot cuppa "You may shut the f*ck up!" with a side order of "I'm a commissioner for the Port Authority of New York!"

That would have put him in his place.
