Selling an SBR

Is there an issue selling a registered SBR to another party via a private sale? Dealing with the new tax stamp is all on the new owner is it not? Thanks.

True, if the ATF is faster at delisting items from the registry than they are adding them?
 
You will have to do it via a Form 4 transfer at an FFL (not sure if they have to be a SOT), unfortunately it is not the simple process it is for non NFA items and the buyer is subject to the $200 extortion fee and wait times.
If it’s in-state, no FFL involved

In-state, it’s fairly straight forward. Fill out the Form 4 and pay the $200. You’ll maintain possession until it’s approved.

If it’s for an out-of-state buyer, it’s two Form 4s, $400, with an FFL (doesn’t have to be a SOT) in the middle.
 
You could also remove the upper and sell the lower with no paperwork. Buyer would have to file a new Form1, pay the $200, and engrave again.

If you sold the upper later, that’s up to you.

Now on a form one as I recall the questions they ask are you planning to or do you intend to sell the item....

In talking to an ATF agent and at a FFL SOT... it sounds like the new free forms they want to keep those form 1 builds from ever being sold or transfered.

I would pull it from the list and sell of the parts if it was mine and not some special high end SBR.

Helps to know what type and value you are talking about.

No issues, but there is a process. You can’t just take the money and give them the SBR just because filing and paying the tax is on them. They get the stamp, then they get the gun.

Once you’re paid, if intrastate then you can hold until they get the stamp and if interstate then their FFL holds until they get the stamp.

As @BigWaylon suggests, might be easier to make it not an SBR and sell it as a rifle or pistol.
 
Inform the ATF to take it off the registry , sell it as a pistol then they can do it form 1. Dont over complicate things.
 
did we find out for sure that this is an AR or something that works the same way?
Otherwise, silversolder a really long muzzle device...

How?

The only difference between a SBR filed on a regular F1/F4 and a SBR filed under 2021R is the $200 tax…laws/rules are the same for both.

Sounds as though someone fed you a line of mierda.

The "great" thing about ATF's newest rule is the opportunity for more Gun Shop Fudd Lore. At least we are no longer living in the times when the only gun information available was from Gun Shops, Guns and Ammo magazine, American Rifleman, and Uncle Jerry (who was either a cop and/or was in Vietnam and therefore "knew" guns).

I’m asking to learn, and know what I can and cannot do. Currently don’t wish to do anything.
then yeah, you should just be able to rebuild to a non-nfa config and sell.
I could point you to the ATF webpage that tells you about it, but a related page says you have to tell them if you change the barrel length, which we know is not entirely true

Im an FFL holder with an SOT .

Nope. Theyre just regular SBR's. No different.

Past form 4's had no SSN

Current form 1's have SSN on them.
I just black them out before I print or after.

Did form 1 always have the questions about making it for sale or planning to sell it along with SSN on them?

All my others were Form 4.
The current 10 were tax free SBR form 1

@wired has already answered this, but entering your SS# on the form is optional, just as it is when you complete a 4473.

That said, your SS# is the easiest way to positively identify you and providing it will make the BGC go quicker/without hiccups.

I never did in the past. For some reason on this batch silencer shop used it it sounds like.
Never on a form 4 but now only on the form 1.
