IMO that looks like legal open carry.
 
I’ll preface this by saying, “I have done absolutely no research on this point.” But, it looks like the person makes no effort to conceal the handgun. It is obvious. Really, you’d see the same amount of gun if it were in an OWB holster. Looks like open carry to me.

I am going to sell belt stickers and flashing red magazine lights to those who want to be absolutely sure that their piece is open and obvious. Can never be too careful.

I don't know if it still applies, open carry used to be defined as the gun can be seen from 3 directions. ie. front, side and rear.

I don’t think that ever applied. Never heard of such a test. Not even sure how one would apply it. So many variables depending upon the observer’s orientation. Under that standard, somebody would fail if they had the gun strapped to their chest or even duct taped to their face.

I’m more commonsense test is appropriate.

Apparently, the LEO who taught my friend's CHP class says those holsters are legal for open carry. So we know what the local opinion is in that county anyway.

I wouldn't trust the instructor to know how other departments would think. My experience is it's kind of a judgement call until it goes to the Magistrate or court. I have seen and questioned on of a guy had a gun down in a cup holder(at night) but the only reason an officer saw it at all was the night sights. I'm pretty sure it got tossed by the Magistrate.

The class is set up through the biggest gun shop in their town and taught at the county sheriff's range with LEO teaching it.

Guy- I'm open carrying.
Officer- No, that's concealed.
Guy- How did you know I was carrying?
Officer- I saw the gun.
Guy- If you can see it, it's not concealed.

BTW, that is called the VA tuck. Because before VA changed their law you could not drink and CC, but could drink and OC. So you just tuck your shirt behind the gun and voila, you are open carrying.

I’ve heard it defined that way by a former boss, but he was from the Midwest, Kansas, Iowa area. He once had an “official” interaction while carrying and got accused of concealing without a permit. He called BS on it declaring it visible from three sides,

My friend has one of your all leather pancakes that I gave him and encouraged him to carry in that if he's going to OC. His concern is retention to avoid what happened a few months back in the Walmart where someone grabbed a guy's gun out of his holster.

He also feels that carrying IWB might provide more retention, and I pointed him to your hybrids, but last night night he told me he's just going to try a Safariland with the GLS retention system that's at his LGS.

I get what you're saying but always remember it's going to go back to the officers opinion. Not every Leo in your county is employed and trained by the sheriff's department.

It's called "situational awareness", why would you let someone, anyone that close to you?? Head up butt..... results deserved..

FWIW, I have a friend who carries like that and he's never had a negative interaction with the Police while carrying.

Could I sneak up behind someone?? You betcha I could, most people either have their head up their butt or their on the phone looking for an App to help them get it up there!!
Could someone sneak up behind me?? Extremely unlikely, my head and senses are on a ball bearing swivel anytime I'm out of the house and even when IN the house I'm always alert to any "strange" noise. Plus no one knows I even have a gun, much less where I'm carrying it.......

We are talking about open carry where your gun is visible. You must be a super hero with eyes in the back of your head if you think that no one could ever get the drop on you.
