I see a lot of pistols for sale requiring concealed carry permit and driver's license. I've even seen long gun sales with that requirement.
How long has this been?
I've lived in 3 states, MS, LA, and SC and none have required permits to buy or sell guns.
It sounds odd that NC would require this.
What's the story?
 
NC requires a pistol purchase permit issued by your local Sheriff or a concealed carry permit to purchase handguns.
 
NC doesn't for long guns. If you think about it that's really the only way a seller knows the buyer isn't prohibited. Is it 100% fool proof? No, but it's better than guessing.

I'm sure the abuse of the PPP has harmed more than it prohibited.

I have taken a person's word and if I didn't like it I aborted. I know we all agree that any hindrance to gun ownership is abhorrent. I was just curious as to how this happened, what the history is.

100+ years ago, the NC state gov didn’t want black folk to be armed, so they made up a “permit” system. aka Jim Crow laws.

Now, it’s a revenue source they don’t want give up.

This is how it ought to be, and how most here at CFF want it to be... but as @Tim pointed out, we in NC have a history of permits for handguns.

Outside of that, no permits or bills of sale are required for private transfer.

I have a different take. 100+ years later, it’s apparent that NC’s Democrat governor still doesn’t want blacks to be armed. He had a chance but vetoed the law that would have abolished this.

Yeah NC is beautiful, I mean breathtaking. Those draconian laws though.

No it's wrong on all levels. You are not law enforcement. For instance in SC, I simply ask if you are legally allowed to purchase. If you aren't and you tell me you are, it isn't my problem.
 
It allows you to waste half a day going TO the Sheriff's office, getting the permit, and THEN going to the gunshop, which is, invariably, equally as far away, in the OPPOSITE direction. :rolleyes:

I don’t think any sheriff does them “same day” any more. The legislature added some mental health nonsense a few years back and that takes some time to process.

But at least it was nice to not have to apologize for Lindsey Grahamnesty anymore.
 
There are no laws pertaining to gun sales. Shall not infringe is what the Constitution says. So all the made up requests by .gov are unconstitutional & not valid. As a Citizen you are required to disobey all unconstitutional requests.
I don't disagree. On another forum guys are up at arms about taking the covid vaccine. I wonder how many of them who are so vocal about never submitting own unregistered MGs, SBRs, have no cwp/CCP, and freely buy and sell pistols without involving an FFL or requiring other paperwork. I would love to be one of those guys, but yes, I have bent the knee.

I think the law states it closer to "seller has no reason to believe the buyer is a prohibited person" rather than "seller must determine if the buyer is an authorized person".

A seller is not required to determine "prohibited-ness".
 
Obviously states are different.
Recently I was in my favorite FFL shop (Tennessee) with one of my sons that was visiting from Florida. I asked what the law was on my son being able to purchase a hunting rifle from him during his visit.

Apparently Florida and either North Carolina or South Carolina will not allow Tennessee to sell a rifle to anyone from those states. Other states allow it but some have some obstacles like a waiting 2, 3 or maybe even 4 plus days.

Question. If I (Tennessee Resident) come to North Carolina to purchase a rifle or shotgun what is the lawful procedure either private or from a FFL shop?
I know there is some FFL guys on here I just don't know them yet. I would appreciate their feedback.

Apparently Florida and either North Carolina or South Carolina will not allow Tennessee to sell a rifle to anyone from those states. Other states allow it but some have some obstacles like a waiting 2, 3 or maybe even 4 plus days.

I have no idea what you’re talking about with states not allowing TN to sell somebody a rifle.

Federally, anybody can buy a long gun from an FFL in any state, and walk out with it.
Federally, nobody can buy anything else (handgun or other firearm) from an FFL outside of their state and walk out with it…it must be transferred to an FFL in the buyer’s state.

Federally, you can’t directly transfer any firearm between residents of different states. You have to transfer it through an FFL if it crosses state lines, either by actually crossing it or just on paper. And when the FFL is involved, you’re back to my first set of statements. Long guns in either state, anything else has to be in the buyer’s state.

And you have to be 21 to buy a non-long gun from an FFL, which you’d only have to be (federally) 18 to buy the same item from an individual.

Sounds like your favorite local toy store doesn’t understand federal law, or just didn’t want to sell a hunting rifle.

Interestingly, my buddy and I ran across a situation like this in West Virginia. A few of us met up and went camping in WV. We stopped in a local gun shop. My buddy (NC resident) was interested in and wanted to buy a Ruger 10-22 takedown. The guy behind the counter told him he can’t sell a rifle to out of state residents. Just kept saying it was the rules. Even when we pushed the issue a bit, questioning if that was the store policy cause it wasn’t prohibited legally. So we left it at that and just left. His shop his rules I guess.

Yep. Not a federal rule. But I won’t even pretend to know state or local laws, much less know store policies. 🤣
 
I went to an Academy here before I moved here and they stated that they don’t sell any firearms to out of state residents. I pushed back and ask for the manager and was eventually able to purchase the shotgun.

Not really a dumb question. A shop that sells 100 guns a week might be able to sell 101 or 102 if they sell to folks from out of state. it’s simply not worth it to the owner to bet that he knows the rules well enough to process the transaction.
