Help Needed!! BIL Just Got Arrested Carrying in NJ

If you get more information and feel comfortable sharing, I would like to know what they did with him, and where he is now. Was he arrested? What, precisely, were the charges? Did he have to post bond? How long did they hold him? Did they say that since he's out of state, he's a flight risk and had to remain in NJ?

The point of posting NC lawyers is to call a NC lawyer’s secretary and ask if they can get a reference for someone in NJ.


Id rather post something half ass supportive than tell the defendant hes an idiot

I get that but it's highly unlikely they could help referring for NJ. I like the support though.

You know, if you weren't listening carefully in your CHP class, you might remember the part about NC recognizing all other states' permits, and somehow think other states did the same. And last year when the US House passed the bill (only to have it die in the Senate), it did make the news; a casual listener might have thought it was now law.
 
I have to ask, was your brother aware of the consequences of being caught with a gun in NJ. And if not, why? Like someone posted earlier, one should know to research gun laws in other states before traveling. Especially if they took a CC class. I hope he gets this over and done with as quickly as possible. I sure wouldn't want to be in his shoes now.
On the other hand, New Jersey should feel so much safer disarming non criminals. They should use their time and resources to crack down on the folks who are actually committing crimes instead of catching and releasing.
 
I'm thankful my life situation doesn't dictate that I have to travel north or northeast of WV. I'll never go up there. I always make it a point to schedule my flights so I can avoid a connecting flight anywhere in the northeast.

I flew out of Newark not so long ago. They found a stray .357 cartridge in my carry on. I was pulled aside, given a nice little room all to myself for about an hour before they were gonna haul me off to Rikers or wherever. At the end of it all, the airport cops were pretty cool, told me not to do it again and I made my flight.
 
No advice on the legal side. But I offer my condolences to your sister.
This is how we should react. This man needs help. He was exercising his rights given by men over 200 years ago.

I think we should call our senators and ask them to get Trump to pardon him on day one of any jail time if it goes that far.

My co-worker got popped in NY a couple years ago. Got a decent attorney by seeking a reference from a pro 2a lawyers association he found online, big fine, forfeit gun, plea to misdemeanor, did not have to stay in or return to NY took several months to resolve. Was a rural county though. Best of luck to them.
 
Yep, retainer and then charged for everything down to postage stamps. Don’t forget bail bondsman also ... I’ll bet NJ will not let him be released on his on recognizance this is at least 1 felony charge for “invading the safe borders of the Garden State with his nasty unlawful gun” so add in $1k plus for that.

For some reason I do not see this as a trial thing ... plea down to a misdemeanor with 3 years probation meaning NJ makes money without having to feed and house this crazed criminal who invaded their state. The DA’s office gets their record padded and everyone is happy except the poor southern who got screwed.

As much as it sounds great going to trial and winning ... ain’t gonna happen up there. Then appealing would add more costs and likely nothing changes. Appeals take time also ... add a year or two. The powers that be up there know 99.66% of the time they have out-of-staters by the shorthairs and can bully them into a crappy plea because of the added expense of being out of state.
That's part of their "legalized extortion" racket. NY does it too. NY considers the trunk of a car to be a single container. So even if one has unloaded and disassembled firearms in one locked case and ammo in another locked case, if they are both in the trunk it is considered a loaded gun.

Really? Two locked containers, inside a locked trunk is not considered to be two separate containers??????
 
This is probably going to be long and expensive. I remember years ago when NJ started down this road the cases weren't even up to the judge for sentencing. Possession of HPs and guns carried a Mandatory 1 year sentence. I hope this still isn't the case??? This is why I don't travel North of Dillon, S.C.

I'll share info as I get it. I just got home from work. Here's what I've heard 3rd hand so far:
He was arrested, I was told several officers told the magistrate (or whoever initially charges him) that he just made a mistake and to release him, so he's not behind bars (very good sign). He was travelling through NJ, and he's from (as he pronounces it) Kanaatikut, maybe the yank accent helped.

50's... I bet they assume he's a cash cow. They will want his money and will make it as easy as possible for him to be relieved of it.
You just summed up the legal systems in this country. Worthless in terms of real crime. Only good for extorting money out of the productive. What a disgrace..

He would’ve probably gotten in less trouble for fleeing the stop and dumping the gun in a spot where the pursuing officer didn’t have eyes on.

Jesus I feel for the guy but I can’t reconcile in my brain “Heres my permit and I’m carrying, officer” in New Jersey
 
How hard is it to get a carry permit in CT?
Not that difficult. I had a CT permit when I lived up there but I had it before Sandy Hook. And, open carry is good in CT.

This is a good excuse for why I am a backpack hoarder. Have multiple bags for all sorts of things. My travel packs are always gun and ammo free.

I questioned about having guns in the trunk when I was driving back and forth to Baltimore because I had a SUV. The State Police said that the guns and ammo had to be in locked containers where I could not reach both at the same time.
 
Nope. Same with a suitcase. FAA says two locked containers inside the suitcase is okay. NY calls that a loaded gun. Same with a car trunk.

Well...if you're not allowed to have any of that in the passenger area, what the hell are you supposed to do?
What's the term for when you get trapped by laws designed to screw you from circumstances you can't avoid?
