I read that Becerra, as current Cal. Atty Gen, is involved in the liability lawsuit in Calif involving "ghost guns" to the extent he asked the ATF in Sept, before the lawsuit, to reclassify ghost guns as legitimate firearms. /Newsmax

Yes, but most of them were already Senate approved from their previous jobs, he just shuffled them around or promoted them. There were a few recess appointments. Even JV POTUS BHO did a few recess appointment that were not legit, the Senate always had somebody there so they were not on recess.

Nope. Even if she did, it wouldn't hold up to a legal challenge.

The tax stamp is part of the law, and Executive Orders can't change the actual written laws. They can legally shape policy, but they cannot usurp Congressional authority nor grant the President powers he does not already have by the Constitution or statute (and if by statute, Congress can change that if they want). He cannot simply give himself new powers, such as to write or re-write laws, which are the purview of Congress. (He may, however, provide guidance/clarification of existing laws where they may be vague, as one example.)

Executive Orders have been challenged, and over turned, before for things like this.
