Seems the ATF is saying they never certified 23 different braces made by SB Tactical, including the SBA3.

Brace is a brace. They are on a power trip at ATF.
If the brace has patents then they are all the same.

While I think this is all bullshit, so if I have to remove the brace to go to the range, I don't think it will affect my shooting much; I mean shooting off the tube alone. One would hope the cops would just look the other way in the event the future idiot in chief has the kooks ban pistol braces but I ain't holding my breath on that.

When change like that happens overnight, that's when you know tyranny is afoot.

Govco has been using the night hours for years to dump documents and pass legislation NOT intended to benefit the American people.
 
It’s unfortunate that it’ll likely require an individual to be a test case, but I hope SB Tac, Q, and many other gun companies can come together and fight this in court without a sacrificial lamb.

The fact that the ATF has flip flopped repeatedly on braces and refused to make rulings on accessories as of a few years ago, should really hurt their case.

I know we are still waiting for more clarification as usual but on a side note what does this do for ar-pistols legally classified as "firearms/ overall lenght <26in" because of the overall length and reclassification from a pistol to a firearm it is no longer a pistol and not subject to pistol requirements.

I personally think there’s too many out there for the ATF to actually do anything at this point. “Common use” comes to mind but there’s no telling what gun laws will look like in the near future. May come down to the SCOTUS and hopefully they’ll side in our direction.

Damn, that list of invasive, freedom robbing and wallet lightening .gov bureaucracies is depressing.
 
The Ammoland article is bluntly just horrible about generalizing, while paying attention to the tiniest detail is everything when dealing with a government bureaucracy like the ATF.

The ATF to SB Tactical letter is two and a half years old and it is very specific in saying:
(1) only two models of SB Tactical braces had been reviewed and classified by ATF;
(2) the ATF classifications of those two models did not carry over to other models, and;
(3) ATF listed a bunch of models of SB Tactical braces and specifically said they were not approved by ATF.

The so-called ATF approval letter for the SB Tactical SOB and SBM4 is anything but an approval for those items:
(1) The ATF's "Conclusions" on page 5 of the letter are simply that four weapons are "firearms" as defined in the law.
(2) While the letter mentions braces by SB Tactical as being parts on the weapons, it does not even state the models of the braces.

Understand that the ATF is a government bureaucracy and any "permission" they give will be as narrow and limited as possible. OTOH, SB Tactical is an innovative company working in a free market, so any "approval" they get will be interpreted in the broadest and most unlimited way possible. And when the two approaches get crossways of each other, a judge will end up deciding the issue.
 
I personally think there’s too many out there for the ATF to actually do anything at this point. “Common use” comes to mind but there’s no telling what gun laws will look like in the near future. May come down to the SCOTUS and hopefully they’ll side in our direction.
Too many bump stocks too.
 
So I just emailed the President, maybe if he gets enough of these he will jump. Going to try to send it to the NC folks too. My text:

Mr. President, As a great American and our Leader, I urge you to help so many other great Americans by stopping the madness that is the ATF and their arbitrary and capricious actions. They continue to harass and threaten law-abiding citizens, gun and gun accessory manufacturers, and many others by acting without check. They have tyrannically violated our 2nd amendment rights and continue to push for more "control" and limitations based not on facts and law, but opinion and prejudice. Their efforts are a waste of tax dollars at best, and flat out unconstitutional at worst. Their recent actions towards the companies of Q and by extension SB Tactical are further proof that they will continue this tyranny until action is taken. I urge you to help so many of your supporters, us great Americans who understand the importance of the constitution and the value of the 2nd Amendment. Thank you for your time and I would be happy to discuss in further detail if you'd like.

And the article makes it clear that the action the ATF is taking against Q is an extension of the actions that started against SB Tactical in 2018. Bottom line is, we need to be prepared to go hard against this one. I wish I'd have done more for the bump stock issue, but I didn't. That's in the past. I'm doing everything I can with regards to the brace issue.

Here is what is written on the back of the sbtactical sba4 box I have in front of me:

"ATF has determined that attaching a Pistol Stabilizing Brace to a firearm does not alter the classification of the firearm or subject the firearm to NFA control."
 
So it sounds like the SBA braces are questionably "legal" to possess if installed on a pistol and have been for two years.
Based upon my reading of the letter it seems like only braces with letters specific to the submitted brace are "legal" or perhaps the better term here is "approved." So if you're concerned about this run out and buy a brace with an approval letter like the GHW Tailhook mod 2 to keep your pistols compliant.

Stands to reason that this news would break now that political winds seem to have shifted. It lines up with the discussion across the online gun communities about ATF/Biden coming after 80% firearms and braced pistols. They may not be able to crush this entirely, but they can crush the biggest producer SB Tactical. The little guys in this market who have produced actual braces that seem to have value as functional braces with ATF letters may survive a while longer as they jumped the hoops and assumed nothing.

If you actually read the 2016 ATF letter relating to the GHW Tailhook Mod 2 it actually states that it can't be shouldered without "making" an NFA controlled firearm, but otherwise is a legal accessory for a pistol. This is exactly the old advise we had prior to the newer advise that stated occasional or inadvertent shoulder contact was permissible. Either way, it's clear that possession alone of the Tailhook Mod 2 is not an NFA violation.Letter.JPG

This 100%. If you look closely what has happened is that the industry and the larger gun community took a very narrow "letter" specific to 2 models of SB Tactical Braces and applied it universally. SB tactical marketed all of their braces as "ATF approved". Look at this pic of the box. We now find ourselves in limbo again. When we accepted the ATF "letter" as gospel for all braces those who did it with eyes wide open did so with the understanding that the "Letter" could be invalidated or changed at anytime. It was never law. It was an opinion which was subject to change. SB Tactical and others marketed it as if it was "law". I don't blame them but if you really dig deep their position is pretty weak. It is not jus the ATF which has left us hanging it is also the industry SB Tactical and others. IMHO

It sucks but this is my take on it. People bought the braces with the intention of "occasionally" shouldering the gun as a way around the NFA and the associated tax stamp. I think if people are being honest with themselves they know that this is true. So at this point the rug has been pulled out from under us and we will have to figure out what is the proper way to proceed.
