??? on CHP application process

I recently got mine in Cumberland Co.
I also had a 5-6mo wait
but once I got in, I think it was just a little over a week until they called to let me know it was ready to pick up.
not that i would have been illegally carrying during those months... but it was nice to know it was suddenly a lot less likely that i would be breaking laws if i did carry.

interesting

the statute on NC reciprocity does not mention residence of the permit holder. it plainly states the permit is honored.

interesting question. did the person at the doj write this down including statutes or was it a phone call. not questioning that someone said it, but i do think they could have been wrong (answering off the cuff rather than in the context of trying to prosecute a case).

NCDOJ is notorious for interpreting gun laws in a stricter manner than they are written. It started AFAIK with Cooper and the gun law publication. Some of those interpretations are just flat wrong, and not in our favor. It would not surprise me at all if someone who does not like non resident CC permits just waved their magic Gov wand and made them "illegal" for NC residents.

When I talk to them, I am going to get the NC #.....going to try. Spoke with 6 different instructors.....and got 2 answers. So I am going to follow this all the way to the end!

The law is simple. If a state issues a non-resident permit NC will recognize it. So VA has a non resident permit. It is legal here. GA does not have a non resident permit so if you have a GA permit and move to another state say NC and change your DL, even though the GA permit may not have expired it is not recognized by NC since you are no longer a resident of GA.

Here is a good article with a list on non resident permits. https://aliengearholsters.com/blog/non-resident-concealed-carry-permits-for-travel/

SC does issue a non resident for people who owns property in SC.

Yes I changed it to GA but still a SC permit is not open to anyone like say VA. Bottom line is, if a state issues a non resident permit then NC will honor it.

If the person in VA owns property in SC, then yes they can get a SC non resident CCW. Just to make sure we are on the right page. As for NC resident not having a CCH from NC .... That is the question in which DOJ told me no. But I am going to get the law #. Going to find out one way or another. I am own a mission!

Not sure what you are asking? If a NC resident legally has a non resident permit from another state then NC will recognize it. There is no law that says they won't.

That is the question? I have been told (made calls 4 years and 2 yars ago) to ncdoj. I was told if you are a resident of NC you have to go through class for CC. Both told me they except all non resident CC from other states if that person lives in another state and comes to NC.
Ex: if a person lives in NY and has a VA non resident CC, NC will honor it.
Ex. 2 If same person moves to NC and now a resident of NC he has to change is DL within so many days. At that point the VA Non resident is not excepted for that person. That person now has to take NC class of CC.

I am asking my contact and NCDOJ. He will know the answer.

Just because the use of a different word in this case really changes the meaning...

It’s accept, not except.

This is the only thing I have found.
. Concealed carry is legal for residents with a North Carolina Concealed Handgun Permit (CHP) and for non-residents with any valid license/permit.

It does not say resident of NC can carry with a non resident permit. It said a Non resident can.

FYI... you CAN'T purchase on a nonresident permit. You CAN purchase, in the mean time, with a Pistol Purchase Permit. 1 permit allows you to buy 1 handgun. You must surrender 1 permit to the ffl per handgun purchased. The PPP can be had from your local sheriff. They're $5 each, I think, and are good for several years. You can request multiple permits from the sheriff at one time. I would still pursue getting your CHP in the mean time.

That's what I'm dong.

So my contact at the NCDOJ says currently you can carry in NC as a NC resident with a non-resident permit from another state. Unless the legislature specifically changes the law it is legal to carry in NC as a NC resident with a non resident permit from another state. I asked for a specific statute and I am waiting for a response to that. There maybe no statute and that is why it is a grey area.

NCDOJ tends to forget a simple tenant of the law. That which is not expressly prohibited is legal.

Heavens no!

We all know it's far more noble to be dead and law abiding than to exercise one's constitutional rights without permission from The Man.

Good God I have forgotten how retarded NC’s process is. In TX you take your class, go to one of the state approved fingerprint sites, submit your application online and after it’s processed they mail it to your house.

Ok, I called and spoke to one of the main people and will leave name out. I stand corrected, because NC excepts all carry permits, and the way the law is worded you can be a resident of NC and have non resident CC and it IS GOOD for NC CC!! This has now been confirmed and I will now teach this in my class!!!!
Also He was not aware Nevada has dropped NC CC. He said he will check in to it and drop them from the DOJ web page.

thank you for calling.

I would love to see the Nevada thing fixed. it is obviously a common tourist and conference destination.

Just wait ... Commiefornians are moving into Texas by the tens of thousands ... Austin is beyond “keep weird” ... Houston is now the one with a problem not NASA ... Texas will be full on retard because of this stuff before long. Thing is true Texans might not stand around like other places and they have lots of feral pigs who are hungry to “handle” problems.

As an instructor, I cant accept giving bad info to my students. I decided to go to the top so there would be no ifs, ands, or buts. Thank all who brought this up again!!!!

Accept...you keep missing the word. Sorry.

Thanks for the leg work.

I am driving down the road and using voice commands. Plus I have a sorry phone and I can't see what I write until after it is posted. I don't feel like buying another phone for $1,000. So I keep using this piece of crap. I stand corrected again.

I finally got my CHP.
- Attended CC class 2nd Saturday of Jan 2021 @ PDHS in Raleigh
- Sent application the following week, got an appoint to submit application mid-July 2021
- Submitted application per mid-July 2021 appointment
- Got permit in mail mid-September 2021
Whew!

Gotta do my renewal next week, print it out, have JAG notarize it and then mail it into Brunswick County. Will take the mail about 2 weeks to deliver, just right at my 90 day mark. Hopefully, its completed and ready when I'm home for Christmas to pick up. During my last 5 yrs with it I've only been home about 11 months to carry in the US :(

Problem is NC all police and sheriff's departments are separate things. They don't have a central organized force like in SC. Which is SLED. South Carolina law enforcement division. So they do things at their own pace and with their limited resources.

Abu Dhabi UAE, same company and job (fixing guns and instructing). Disassembled and inspected another minigun today. Kind of hard to conceal that as the whole system with 9,000 rds is 900 lbs.

I use to work on the the big brother...I worked on the M61A1's in the F-15, remove from the AC, disassemble, inspect, reassemble, and install back in jet.

Not if you are a resident of NC. That is what DOJ. Told me when I called them.
I don't think that is correct, I carried for 5 years with a UT non res permit and had several LEO interactions with no issues. Can you point us where exactly it says that in the law?

I hope Brunswick county is faster than Durham. I renewed back in April and haven't heard from them since. They said it was a 3-4 month delay, but, damn.

If you start the renewal process before it expires your current CHP will be valid until the new one arrives. At least for carrying. For purchasing, it might cause issues. And this year, I'd definitely start early.
That would be great, are you sure about that?

I'd have to say residency is mentioned nowhere at all so all permits are honored, if they wanted to make a distinction between permits this would be the place they'd have to have that listed.
