No Justice for Ashli Babbitt

Legit question to those who feel that the Capitol officer who shot the girl was in any way justified since the crowd was breaking in and PSGWSP and such...

If this officer had an MP5 or Uzi instead of a pistol, would you be cool if he just opened up full-auto on the entire crowd? How about the two officers right behind her? Would it have been OK for them to just start picking off protesters? Or is just one OK maybe to set an example for the rest?

Help me understand this, 'cause some of these replies are a bit disconcerting.
 
I'm not sure I understand your point. Self- or third-party-defense is analyzed by the viewpoint of the shooter in the moment. That protects people from government prosecution for circumstances in which facts later prove there was a misunderstanding (think of the YouTube "prank mugger" in Tennessee killed recently). That's not positivism. That's a naturalist view of self-defense that applies to everyone in uniform or in civilian clothes.

Are you saying that a superior officer commanded the officer to open fire? And the officer fired without any knowledge or consideration of the circumstances?

No, but I do submit that a positivist mentality to use any means necessary to carry out his "charge" as instilled by his superiors and allegiance to the system order led to an illicit use of force in this case.

Obviously, I can't speak to what was in the officer's mind - and, because this was administratively dismissed, no one will be able to examine that question outside of a civil suit. Was Ms. Babbitt a personal threat? Seriously? If, rather, it was the "crowd" or "mob" why didn't the officer mag dump to eliminate the threat? No, I think the idea that law (or statute) makes right was in play here, and that is the essence of legal positivism (unless it was simply panic).

And unrelated to the issue of positivism, I find it troubling that this case is subject to an administrative dismissal rather than being deferred to a court proceeding: that was my perspective in titling the thread as I did.

I'll leave it at this for here for my part. As we both agree, I suspect, a for-real discussion of nuanced issues requires time to lay out presuppositions and how we intend words to be defined so we could take this to chat if you wish to discuss further.

As of 2012 Ft. Worth US house rep is democrat.

My grandfather was born and raised in Ft. Worth. He'd roll over in his grave if knew parts of Texas have gone full lib.
 
Not all protesters broke in. Saw a report last night that the capitol police were told to stand down that day. There are reports and videos where doors were opened and people allowed in.

It was a perfectly timed set up to ensure there was no debate or investigation into election irregularities on the floor. Trump was still speaking when the group was let on to the property and into the Capitol building by the PD. And did anyone notice the BLM guy that was there was released quickly and quietly? Pretty slick. Have a group of BLM and Antifa types dress up as Trump supporters with hats and flags and get them to lead the way in. And unfortunately some fools followed. When there were lots of videos circulating you could hear people yelling ’he’s Antifa’ and imploring people to stop the plants from destroying property.

He is black, from North Carolina, and a BLM "soldier" based on his social pages. Forgot his name, but he should have been famous, or notorious, by now.

If this is correct then it’s an even more complex set up. They even had BLM/Antifa types on the inside to inflict violence. Not just paid off patsies to allow thing to happen.

People need to get what’s coming to them. As Maximus would say, “now or in the next life.”

The media would’ve provided his identity and pics of his social media postings within a day.

Seems like a great candidate for a PD. Guess it’s hard to find good help these days. Wonder if when they ran a background check they thought his online remarks were actually a positive instead of a negative.

No doubt. Pretty sure I remember seeing the logs and seeing a John Roberts. But surely he was just being flown to a legal conference. And his adopted kids have nothing to do about nothing. 😏

"Washington, DC – The family of Air Force veteran Ashli Babbitt has filed the first of two major lawsuits related to her shooting death by U.S. Capitol Police (USCP) on the day of the Capitol riot.

The civil lawsuit filed the first week of June in the Superior Court of the District of Columbia asked the court to force the DC Metropolitan Police Department (MPD) to turn over records of their investigation into Babbitt’s death, CNBC reported.

The lawsuit also called for MPD to reveal the identity of the Capitol police officer who shot Babbitt as she made her way through a window into the U.S. Capitol building on Jan. 6."

Very few have that national security exclusion and DC police does not have it. Once in the
courts it will come out.
